Article 70. Actions against the maritime performing party
المادة 70- رفع الدعاوى على الطرف المنفّذ البحري

The plaintiff has the right to institute judicial proceedings under this Convention against the maritime performing party in a competent court within the jurisdiction of which is situated one of the following places:
يحق للمدّعي أن يرفع دعوى قضائية بمقتضى هذه الاتفاقية على الطرف المنفّذ البحري أمام محكمة مختصة يقع ضمن نطاق ولايتها أحد المكانين التاليين:

An inland carrier is a maritime performing party only if it performs or undertakes to perform its services exclusively within a port area.
ولا يكون الناقل الداخلي طرفا منفذا بحريا إلا إذا كان يؤدي أو يتعهد بأن يؤدي خدماته حصرا داخل منطقة الميناء.

Further, the question was raised whether the ability of the parties to agree that certain obligations of the carrier were performed on behalf of the shipper, the controlling party or the consignee pursuant to draft article 11 (2) could be said to contradict the redraft of article 88 (1), particularly given that provision's reference to maritime performing parties.

If the carrier and one or more maritime performing parties are liable for the loss of, damage to, or delay in delivery of the goods, their liability is joint and several but only up to the limits provided for under this Convention.
1- إذا كان الناقل وطرف منفّذ بحري واحد أو أكثر مسؤولين عن هلاك البضاعة أو تلفها أو التأخر في تسليمها، كانت مسؤوليتهم جماعية وفردية، على ألا تتجاوز الحدودَ المنصوصَ عليها في هذه الاتفاقية.

An inland carrier is a maritime performing party only if it performs or undertakes to perform its services exclusively within a port area.
ولا يعتبر الناقل الداخلي طرفا منفِّذا بحريا إلاّ إذا كان يؤدّي، أو يتعهّد بأن يؤدّي خدماته حصرا داخل منطقة ميناء.

Furthermore, there might be doubts as to whether a road or rail carrier that brought goods into the port area would qualify as a maritime performing party for its entire journey or whether it would be a mere performing party until it reached the port area and would become a maritime performing party upon entering the port area.
