The preamble to the draft articles notes that the General Assembly is convinced of the need for the codification and progressive development of the rules of international law concerning nationality in relation to the succession of States.

21. Article 15 prohibited discrimination on any ground in matters of nationality in relation to a succession of States.

They preferred a non-binding instrument which could be of immediate assistance to States dealing with problems of nationality in relation to the succession of States.

٧ - وفيما يتعلق بموضوع الجنسية في حالة خلافة الدول، فقد كونت اللجنة فريق عمل لدراسة مسألة جنسية اﻷشخاص الاعتباريين.

It might be best for the Commission to first undertake a study of legal persons in general, then to deal with the question of their nationality and only then to consider the question of that nationality in relation to State succession.
وقد يكون من اﻷفضل للجنة أن تقوم أولا بدراسة اﻷشخاص الاعتباريين بصورة عامة، ثم تتناول مسألة جنسيتهم؛ وعندئذ فقط تنظر في مسألة هذه الجنسية في حالة خلافة الدول.
