The criteria contemplated in national legislation or applied by national courts offer some variety including, inter alia, the nature of the act, its purpose or motive as well as some other complementary criteria such as the location of the activity and the context of all the relevant circumstances of the act.

Article 272 stipulates that, unless special provision is made otherwise or the nature of the act or omission is such that the ordinary courts may impose different penalties, all breaches of employment or social security provisions shall be punishable as follows:
