In this respect, citation of the Organized Crime Convention as the legal basis within a judicial cooperation request will be successful only if both parties to the request are able to accept the Convention as a " relevant treaty " as a matter of national law and policy.
30- وفي هذا الصدد، لن تكون للإشارة إلى اتفاقية الجريمة المنظَّمة في طلب التعاون القضائي بأنها هي الأساس القانوني أي جدوى إلاَّ إذا كان بمقدور طَرَفيْ الطلب أن يَقْبلا الاتفاقية " كمعاهدة ذات صلة " لأغراض القانون الوطني والسياسة الوطنية.

38. In cases where a reservation affecting Convention provisions on special measures is maintained, States parties are invited to provide information as to why such a reservation is considered necessary, the nature and scope of the reservation, its precise effects in terms of national law and policy, and any plans to limit or withdraw the reservation within a specified time frame.
38- وفي حال أصرّت الدول الأطراف على تحفظ يؤثّر على أحكام الاتفاقية بشأن اتخاذ تدابير خاصة، فإنها تُدعى إلى تقديم معلومات عن الأسباب التي تدعوها إلى النظر إلى هذا التحفظ على أنه ضروري وعن طابع التحفظ ونطاقه، وعن آثاره تحديدا فيما يتعلق بالقوانين والسياسات الوطنية وأية خطط رامية لتقييد نطاقه أو سحبه في غضون إطار زمني محدد.

وفي حال إبقاء الدول الأطراف على تحفظ يؤثّر على أحكام الاتفاقية المتعلقة بالخطاب العنصري، فإنها مدعوة إلى تقديم معلومات عن الأسباب التي تدعوها إلى اعتبار هذا التحفظ ضرورياً وعن طبيعة التحفظ ونطاقه، وعن آثاره المحددة فيما يتعلق بالقوانين والسياسات الوطنية وأية خطط رامية لتقييد نطاقه أو سحبه في غضون إطار زمني محدد().
