Cautioning that the decision of Pre-Trial Chamber I of the International Criminal Court will, under the cloak of international justice, undermine the principle of the sovereignty of States and damage the current peace process in the Sudan,

During the reporting period, the Secretary-General transmitted to the Security Council the decision of Pre-Trial Chamber I of 4 May 2012, inviting the Council to submit its observations on the application of the Government of Libya to the Court challenging the admissibility before the Court of the case against Saif Al-Islam Gaddafi.

To consider the decision of Pre-Trial Chamber I of the International Criminal Court concerning President Omar Hassan Ahmad al-Bashir as a serious precedent targeted at a State President who continues to perform the functions of his position and as a violation of the Vienna Convention on Diplomatic Relations of 1961 and of the principles of international customary law, and to reject that decision and all effects arising out of it;

55. On 24 July 2014, the Appeals Chamber confirmed the 11 October 2013 decision of Pre-Trial Chamber I, in which the case against Mr. Al-Senussi was declared inadmissible before the International Criminal Court as it was subject to ongoing domestic proceedings conducted by the competent Libyan authorities, and Libya was genuinely willing and able to carry out such proceedings.
55 - في 24 تموز/يوليه 2014، أيدت دائرة الاستئناف القرار الذي أصدرته الدائرة التمهيدية الأولى في 11 تشرين الأول/أكتوبر 2013 وأعلنت فيه عدم مقبولية الدعوى المرفوعة ضد السيد السنوسي أمام المحكمة الجنائية الدولية، نظرا لأن السلطات الليبية المختصة تباشر حاليا إجراءات قضائية داخلية بشأنها وأن ليبيا أبدت رغبة صادقة في الاضطلاع بهذه الإجراءات وأبدت قدرة على ذلك.

By his letter, the Registrar, pursuant to article 17 of the Negotiated Relationship Agreement between the International Criminal Court and the United Nations, transmitted the decision of Pre-Trial Chamber I of the Court dated 31 May 2013 on the admissibility of the case against Saif Al-Islam Gaddafi before the Court in the case of The Prosecutor v. Saif Al-Islam Gaddafi and Abdullah Al-Senussi, for onward transmission to the Security Council.
فعملاً بالمادة 17 من الاتفاق الناظم للعلاقة بين منظمة الأمم المتحدة والمحكمة الجنائية الدولية، أَخطر رئيس قلم المحكمة في رسالته بالقرار الذي اتخذته الدائرة التمهيدية الأولى للمحكمة المؤرخ 31 أيار/مايو 2013 بشأن مقبولية الدعوى المرفوعة ضد سيف الإسلام القذافي أمام المحكمة، في إطار دعوى المدعي العام ضد سيف الإسلام القذافي وعبد الله السنوسي، وذلك لأغراض إبلاغ مجلس الأمن.
