3.2 The authors claim that the German reservation to article 5, paragraph 2 (a), of the Optional Protocol does not apply in the present case, as the European Court of Human Rights, in its decision of 30 June 2005, did not examine the " same matter " within the meaning of the State party's reservation.
3-2 ويدّعي أصحاب البلاغ أن تحفُّظ ألمانيا على الفقرة 2(أ) من المادة 5 من البروتوكول الاختياري لا ينطبق على هذه الحالة، لأن المحكمة الأوروبية لحقوق الإنسان لم تنظر، لدى اتخاذها قرارها المؤرخ 30 حزيران/يونيه 2005، في " المسألة ذاتها " وفقاً لتفسير تحفُّظ الدولة الطرف.

7.5 The Committee has taken note of the State party's reservation to article 26, according to which the State party understood this provision " to mean that it does not exclude different treatment of Austrian nationals and aliens, as is also permissible under article 1, paragraph 2, of the International Convention on the Elimination of All Forms of Racial Discrimination " .
