(a) The name and address of the supplier or contractor presenting the successful tender or submission;

1. The purpose of the article is to enable the procuring entity to reject a submission whose abnormally low price gives rise to concerns as to the ability of the supplier or contractor presenting such submission to perform the procurement contract.
1- الغرض من هذه المادة هو تمكين الجهة المشترية من رفض العرض الذي يثير سعره المنخفض انخفاضا غير عادي شواغل بشأن قدرة المورِّد أو المقاول الذي قدّمه على تنفيذ عقد الاشتراء.

1. The purpose of the article is to provide an exhaustive list of grounds for the exclusion of a supplier or contractor from the procurement proceedings for the reasons not linked to the content of a submission presented or the qualifications of the supplier or contractor.
1- الغرض من هذه المادة هو تقديم قائمة شاملة بالأسس التي يُستند إليها لاستبعاد مورِّد أو مقاول من إجراءات الاشتراء لأسباب غير متصلة بمحتوى العرض المقدَّم أو مؤهّلات المورِّد أو المقاول.

Submission which price in combination with other constituent elements of the submission is so abnormally low in relation to the subject matter of the procurement that it raises concerns with the procuring entity as to the ability of the supplier or contractor that presented it to perform the procurement contract.
هو العرض المقدَّم الذي يكون سعره، بالاقتران مع سائر العناصر المكوِّنة، منخفضاً بالقياس إلى الشيء موضوع الاشتراء انخفاضاً غير عادي بحيث يثير لدى الجهة المشترية شواغل بشأن مدى قدرة المورِّد أو المقاول الذي قدَّم ذلك العرض على تنفيذ عقد الاشتراء.

(c) Where relevant in procurement conducted in accordance with articles 47, 49 and 50 of the Model Law [**hyperlinks**], the experience, reliability and professional and managerial competence of the supplier or contractor and of the personnel to be involved in providing the subject matter of the procurement;

Where the supplier or subcontractor is directly implicated in trafficking or the company is indirectly linked to trafficking through the conduct of the supplier or subcontractor, a State's obligation to protect human rights implies that the State in which the supplier or subcontractor is based has the primary responsibility to hold that supplier or subcontractor accountable.
وحيثما يكون المورِّد أو المتعاقد من الباطن ضالعا بصورة مباشرة في عملية الاتجار وتكون الشركة مرتبطة بصورة غير مباشرة بعملية الاتجار عن طريق سلوك المورد أو المتعاقد من الباطن، يعني التزام الدول بحماية حقوق الإنسان أن الدولة التي يوجد بها مقر المورد أو المتعاقد من الباطن تقع عليها المسؤولية الرئيسية عن محاسبتهما.

(a) The procuring entity has requested in writing from the supplier or contractor details of the submission that gives rise to concerns as to the ability of the supplier or contractor to perform the procurement contract; and
(أ) قد طلبت من المورِّد أو المقاول المعني كتابياً تفاصيلَ العرض المقدّم الذي يثير الريبة بشأن قدرة المورِّد أو المقاول على تنفيذ عقد الاشتراء؛

(a) the qualifications, experience, reputation, reliability and professional and managerial competence of the supplier or contractor and of its personnel;

(6) (a) The procuring entity shall disqualify a supplier or contractor if it finds at any time that the information submitted concerning the qualifications of the supplier or contractor was false;

(b) A procuring entity may disqualify a supplier or contractor if it finds at any time that the information submitted concerning the qualifications of the supplier or contractor was materially inaccurate or materially incomplete;
)ب( ويجوز للجهة المشترية أن تقرر عدم أهلية مورد أو مقاول إذا اكتشفت في أي وقت أن المعلومات المقدمة بخصوص مؤهلات المورد أو المقاول مشوبة بعدم الدقة أو النقص من جوانب أساسية؛

2. In procurement by means of an auction that was not preceded by examination or evaluation of initial bids, the procuring entity shall ascertain after the auction the responsiveness of the successful bid and the qualifications of the supplier or contractor submitting it.
2- في حالة الاشتراء بالمناقصة الذي لم يَسبق فيه المناقصةَ فحصٌ للعطاءات الأوَّلية أو تقييمٌ لها، تتأكد الجهةُ المشترية، بعد المناقصة، من مدى استجابة العطاء الفائز للمتطلبات ومن مؤهلات الموَرِّد أو المقاول الذي قدَّمه.

Stockholdings of contraceptive products established under Regulation 14.9 above may be held at the premises of the supplier or at alternative secure premises deemed suitable for the storage of contraceptives, medical and pharmaceutical products.
يجوز الاحتفاظ بمخزونات منتجات وسائل منع الحمل المكونة بموجب البند 14-9 أعلاه في مباني المورّد أو في مبان آمنة بديلة تعتبر مناسبة لتخزين وسائل منع الحمل والمنتجات الطبية والصيدلانية.
