214. In the light of these new developments, the Heads of State and Government decided that the sanctions imposed on the Libyan Arab Jamahiriya must be suspended once an agreement has been reached between the Libyan Arab Jamahiriya and the countries concerned on the arrangements and the guarantees leading to the appearance of the two suspects before the Court.

3. That agreement should be reached on guarantees of the legal, religious, personal, social and medical rights of the two suspects throughout the various stages of the trial, as well as on guarantees of their security and safety during their travel to and from the Netherlands and during their stay there;

Not only did collective sanctions blatantly violate the rights of the two suspects and the Libyan Arab people as a whole, but they also violated article 10 and article 11, paragraph 1, of the Universal Declaration of Human Rights and article 14, paragraph 2, of the International Covenant on Civil and Political Rights, as well as the International Covenant on Economic, Social and Cultural Rights.

4. Calls on all parties concerned to respond positively to the initiatives for dialogue and negotiations to secure a peaceful settlement to the crisis in conformity with Article 33 of the United Nations Charter, which calls for the settlement of disputes through negotiation, mediation and judicial procedures, and calls for a fair and impartial trial of the two suspects in a neutral country to be agreed upon by all the parties concerned;
٤ - يدعو جميع اﻷطراف المعنية إلى الاستجابة للمبادرات الداعية إلى الحوار والتفاوض بغية التوصل إلى حل سلمي لﻷزمة وفقا للمادة ٣٣ من الفصل السادس من ميثاق اﻷمم المتحدة التي تدعو إلى حل النزاعات عن طريق المفاوضات والوساطة والتسوية القانونية، كما يدعو إلى محاكمة المشتبه فيهما محاكمة عادلة ونزيهة في بلد محايد تتفق عليه كافة اﻷطراف المعنية؛

4. CALLS ON all parties concerned to positively respond to the initiatives for dialogue and negotiations to secure a peaceful settlement to the crisis in conformity with Article 33 of Chapter VI of the Charter of the United Nations which calls for the settlement of disputes through negotiations, mediation and legal procedures and CALLS for a fair trial of the two suspects in a neutral country to be agreed upon by all the parties concerned;
٤ - يدعو جميع اﻷطراف المعنية إلى الاستجابة للمبادرات الداعية إلى الحوار والتفاوض بغية التوصل إلى حل سلمي لﻷزمة وفقا للمادة ٣٣ من الفصل السادس من ميثاق اﻷمم المتحدة التي تدعو إلى حل النزاعات عن طريق المفاوضات والوساطة والتسوية القانونية، كما يدعو إلى محاكمة المشتبه فيهما محاكمة عادلة ونزيهة في بلد محايد تتفق عليه كافة اﻷطراف المعنية؛

We believe that the initiatives we took following the adoption of Security Council resolution 883 (1993) will meet the approval of the two suspects and their lawyers and help the Security Council to discover the identity of the perpetrator of the bombing of Pan Am flight 103 and to punish him, and also to guarantee the right of the victims' families to receive compensation for the loss they suffered as a result of that tragic bombing.
ونحن نعتقد أن مثل هذه المبادرات التي استعرضتها معكم والتي قمنا بها بعد صدور قرار مجلس اﻷمن ٨٨٣ )١٩٩٣( ستلاقي قبول المشتبه فيهما ومحاميهما، كما أنها ستساعد مجلس اﻷمن في التعرف على حقيقة المنفذ لجريمة تفجير طائرة البان آم رحلة ١٠٣، ومعاقبته، إضافة الى ضمان حقوق أسر الضحايا في التعويض عن الضرر الذي أصابهم من جراء هذا الحادث اﻷليم.

This provision runs counter to the general understanding of the initiative, that the purpose of the trial of the two suspects is to reveal the truth in the tragic incident of Pan Am flight 103, and not to exact revenge on two Libyan citizens who are merely suspected, without evidence.
إن أي إجراء محاكمة للمشتبه فيهما يقصد منه إظهار الحقيقة في الحـادث المؤسـف الـذي تعرضت له طائرة بان آم ١٠٣، ولا ينبغي أن يكون القصد منه هو الانتقام من مواطنين ليبيين اشتبه فيهما مجرد اشتباه لا دليل عليه.
