The State party should take all necessary measures to ensure the practical enjoyment by the Roma of their rights under the Covenant by implementing and reinforcing effective measures to prevent and address discrimination and the serious social and economic situation of the Roma.

(21) While noting measures undertaken to improve the living conditions of the Roma community, the Committee is concerned that the Roma community continues to suffer prejudice and discrimination, in particular with regard to access to health services, social assistance, education and employment which have a negative impact on the full enjoyment of their rights under the Covenant (arts. 2, 26 and 27).
(21) ومع ملاحظة التدابير المتخذة لتحسين أوضاع معيشة جماعة الروما، تشعر اللجنة بالقلق إزاء استمرار معاناة هذه الجماعة من التحيز والتمييز، لا سيما فيما يتعلق بالحصول على الخدمات الصحية، والمساعدة الاجتماعية، والتعليم والعمل، وهو ما يؤثر سلباً على تمتعها الكامل بحقوقها بموجب العهد (المواد 2 و26 و27).

The Committee noted that, even if the authors had applied for a release of funds under the humanitarian clause, they could have withdrawn an amount sufficient to cover their basic expenses but would still have had no effective remedy in respect of the alleged violations, i.e., a hearing of their allegations of violations of their rights under the Covenant.
وأشارت اللجنة إلى أنه حتى وإن كان صاحبا البلاغ قد قدما طلباً برفع تجميد الأموال على أساس البند الإنساني، فقد كان بإمكانهما سحب مبلغ يغطي مصروفاتهما الأساسية، دون أن يتاح لهما بذلك سبيل انتصاف فعال فيما يتعلق بالانتهاكات المزعومة، أي النظر في ادعاءات انتهاكات حقوقهما على النحو الذي يكفله العهد.

The Committee is also concerned by the significant disparities still remaining between Aboriginal people and the rest of the population in areas of employment, access to water, health, housing and education, and by the failure of the State party to fully acknowledge the barriers faced by African Canadians in the enjoyment of their rights under the Covenant.
