79. With a view to providing a simpler version of a possible provision on Recognition and Enforcement of interim measures, the following text was proposed by one delegation:

While there was support for this view, it was suggested that experience had shown in the context of other negotiations on international instruments that agreement was difficult to reach with respect to provisions on Recognition and Enforcement.

Last year Slovakia became a State party to the Hague Convention of 1993 on Protection of Children and Cooperation in respect of Intercountry Adoption; the Hague Convention of 1980 on the Civil Aspects of International Child Abduction; and the European Convention of 1980 on Recognition and Enforcement of Decisions Concerning Custody of Children and on Restoration of Custody of Children.

It also notes that important international instruments, such as the Hague Convention on the Civil Aspects of International Child Abduction and the European Convention on Recognition and Enforcement of Decisions Concerning Custody of Children, have recently been ratified by Iceland.
وتحيط كذلك علماً بأن آيسلندا صادقت مؤخراً على صكوك دولية هامة من قبيل اتفاقية لاهاي عن الجوانب المدنية لاختطاف اﻷطفال على الصعيد الدولي والاتفاقية اﻷوروبية بشأن الاعتراف بالمقررات المتعلقة بحضانة اﻷطفال واستعادة حضانة اﻷطفال وتنفيذها.

It should be noted that Cyprus, by Law 36/86, has ratified the European Convention on Recognition and Enforcement of Decisions concerning the Custody of Children and on the Restoration of Custody of Children.
وتجدر الاشارة إلى أن قبرص قد صادقت، بالقانون رقم ٦٣/٦٨٩١، على الاتفاقية اﻷوروبية بشأن الاعتراف بالقرارات المتعلقة بوصاية اﻷطفال وانفاذها واسترداد الوصاية على اﻷطفال.

Regarding article 11, the Committee notes with satisfaction that Austria is a party to the 1980 European Convention on Recognition and Enforcement of Decisions concerning Custody of Children and on Restoration of Custody of Children and to the 1980 Hague Convention on the Civil Aspects of International Child Abduction.

544. In relation to article 11 of the Convention, the Committee notes with satisfaction that Sweden is a party to the European Convention on Recognition and Enforcement of Decisions concerning Custody of Children and on Restoration of Custody of Children and to the Hague Convention on the Civil Aspects of International Child Abduction.

There was support for the concern expressed that reaching consensus on provisions on Recognition and Enforcement in the context of the draft instrument would require a great deal of time, and that it would further encumber the draft instrument, which was already regulating matters in a large number of areas.
وأُبدي تأييد لما أعرب عنه من قلق مثاره أن التوصل إلى توافق في الآراء بشأن الأحكام المتعلقة بالاعتراف والإنفاذ في إطار مشروع الصك سيتطلب الكثير من الوقت وسيزيد من إثقال كاهل مشروع الصك، الذي ينظّم أصلا مسائل في عدد كبير من المجالات.

173. Another view was expressed that the cargo claimant, in choosing its jurisdiction pursuant to draft article 72, would be aware of the rules on Recognition and Enforcement applicable in the various possible jurisdictions, and could decide accordingly on which jurisdiction to choose for the greatest likelihood of enforcement.
173- وأُبدي رأي آخر مفاده أن المطالِب بالبضاعة، لدى اختيار الولاية القضائية المواتية لـه عملا بمشروع المادة 72، سيكون على علم بالقواعد المتعلقة بالاعتراف والإنفاذ السارية في مختلف الولايات القضائية المحتملة، ومن ثم يمكن أن يبت بشأن الولاية التي يتعين عليه اختيارها للحصول على أكبر فرصة للإنفاذ.
