The use of the systems that would have a significantly negative effect on participation of suppliers and contractors in procurement would be incompatible with the objectives, and article 7 (4), of the Model Law.
واستخدام نظم لها أثر سلبي كبير على مشاركة المورِّدين والمقاولين في عملية الاشتراء أمر مخالف لأهداف القانون النموذجي والفقرة (4) من المادة 7.

2. Paragraph (1) refers to the minimum information that must be included when the procuring entity first solicits participation of suppliers or contractors in such procurement proceedings.
2- وتشير الفقرة (1) إلى الحد الأدنى من المعلومات التي يجب تضمينها عندما تلتمس الجهة المشترية لأول مرة مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء هذه.

(4) A procuring entity that decides to limit participation of suppliers or contractors in procurement proceedings pursuant to this article shall include in the record of the procurement proceedings a statement of the reasons and circumstances on which it relied.
(4) تدرج الجهة المشترية التي تقرر الحدّ من مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء عملاً بهذه المادة في سجل إجراءات الاشتراء بياناً بالأسباب والظروف التي استندت إليها في ذلك.

(5) The procuring entity shall make available to any member of the public, upon request, its reasons for limiting participation of suppliers or contractors in the procurement proceedings pursuant to this article.
(5) تتيح الجهة المشترية لأي فرد من الجمهور، عند الطلب، الاطّلاع على أسباب حدّها من مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء عملاً بهذه المادة.

(d) In the procurement proceedings in which the procuring entity, in accordance with article 8 of this Law, limits participation of suppliers or contractors, a statement of the reasons and circumstances relied upon by the procuring entity for imposing the limitation;
(د) في إجراءات الاشتراء التي تحدّ فيها الجهة المشترية، وفقا للمادة 8 من هذا القانون، من مشاركة المورِّدين أو المقاولين، بيانا بالأسباب والظروف التي استندت إليها الجهة المشترية في فرض ذلك الحد؛

5. The procuring entity shall make available to any person, upon request, its reasons for limiting the participation of suppliers or contractors in the procurement proceedings pursuant to this article.
5- تُتيحُ الجهةُ المشترية لأيِّ شخص، عند الطلب، الاطِّلاعَ على أسباب حدِّها من مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء عملاً بهذه المادة.

The second new paragraph, 2011 paragraph (5), requires the procuring entity to make available to any person, upon request, its reasons for limiting the participation of suppliers or contractors in the procurement proceedings.
أما الفقرة الجديدة الثانية، وهي الفقرة (5) في نصّ عام 2011، فهي تشترط أن تتيح الجهة المشترية لأيِّ شخص، عند الطلب، الاطِّلاعَ على أسباب حدِّها من مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء.

3. The procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, shall declare whether the participation of suppliers or contractors in the procurement proceedings is limited pursuant to this article and on which ground.
3- تُعلن الجهةُ المشترية، عند التماسها لأوَّل مرة مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء، ما إذا كانت مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء محدودة عملاً بهذه المادة، وأسباب ذلك الحد.

A number of common elements were identified at all Expert Meetings as relevant to increasing participation of suppliers from developing countries in the world trade in services.
