1. Any person whose rights under the Constitution, an international treaty, the law or any other regulation are violated should have the right to seek a remedy from the competent domestic authorities, even where the violation has been committed by persons acting in an official capacity.
1- يُكفل لكل شخص تُنتهك حقوقه التي يضمنها الدستور، أو اتفاقية دولية، أو القانون، أو أي قواعد تنظيمية أخرى، سبيل للانتصاف أمام السلطات الوطنية المختصة، حتى لو صدر الانتهاك عن أشخاص يتصرفون بصفتهم الرسمية.

22. Under article 2, paragraph 3, of the Covenant, " each State Party to the present Covenant undertakes to ensure that any person whose rights or freedoms as herein recognized are violated shall have an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity " .
22- وتنص الفقرة 3 من المادة 2 من العهد أصلاً على أنْ " تتعهد كل دولة طرف في هذا العهد بأن تكفل توفير سبيل فعال للتظلم لأي شخص انتُهكت حقوقه أو حرياته المعترف بها في هذا العهد، حتى لو صدر الانتهاك عن أشخاص يتصرفون بصفتهم الرسمية " .

This provision, which is applicable if an expulsion violates any such right or freedom states that: " Everyone whose rights and freedoms as set forth in this Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity. "
وجاء فيها ما يلي: " تُتاح لكل من تتعرض حقوقه وحرياته المنصوص عليها في هذه الاتفاقية للانتهاك سبل انتصاف فعالة أمام سلطة وطنية، بغض النظر عما إذا كان مرتكبو الانتهاك أشخاصا يتصرفون بصفتهم الرسمية``.

In the same way, article 13 of the European Convention on Human Rights provides that: " Everyone whose rights and freedoms as set forth in this Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity. "
وفي السياق نفسه، تنص المادة 13 من الاتفاقية الأوروبية لحقوق الإنسان على ما يلي: " تُتاح لكل من تتعرض حقوقه وحرياته المنصوص عليها في هذه الاتفاقية للانتهاك سبل انتصاف فعالة أمام سلطة وطنية، بغض النظر عما إذا كان مرتكبو الانتهاك أشخاصا يتصرفون بصفتهم الرسمية``.

27-3 وتنص الفقرة 5 كذلك على أنه لا يجوز للدولة المتعاقدة الامتناع عن توفير المعلومات لمجرد أنها محفوظة لدى أشخاص يعملون بصفتهم وكلاء أو مؤتمنين.

The Committee seeks confirmation that the State party fully complies with the requirements of the Convention that " all public officials or persons acting in an official capacity " are covered in line with article 1 of the Convention.
