16.4 In the instant case and on the basis of the information before it, the Committee concludes that execution by gas asphyxiation, should the death penalty be imposed on the author, would not meet the test of " least possible physical and mental suffering " , and constitutes cruel and inhuman treatment, in violation of article 7 of the Covenant.
٦١-٤ وفي هذه القضية، وعلى أساس المعلومات المعروضة على اللجنة، تخلص اللجنة الى أن الاعدام خنقا بالغاز، في حالة توقيع عقوبة الاعدام على صاحب البلاغ، لن يفي بمعيار احداث " أقل درجة ممكنة من المعاناة البدنية والعقلية " ، وانه يشكل معاملة قاسية ولا إنسانية، تنتهك المادة ٧ من العهد.

11. The Committee's majority is of the view that judicial execution by gas asphyxiation, should the death penalty be imposed on Mr. Ng, would not meet the test of the " least possible physical and mental suffering " , and thus would constitute cruel and inhuman treatment in violation of article 7 of the Covenant (paragraph 16.4).
١١ - من رأي أغلب أعضاء اللجنة أن الاعدام بموجب حكم قضائي عن طريق الخنق بالغاز في حالة الحكم بالاعدام على السيد نغ لن يلبي معيار تحقيق " أقل درجة ممكنة من المعاناة البدنية والعقلية " ، ومن ثم فسيشكل معاملة قاسية ولاإنسانية تنتهك المادة ٧ من العهد )الفقرة ٦١-٤(.
