In Procedural Order No. 52, the Panel requested Iraq and Kuwait to address the issue of the valuation of the Portfolio Loss by answering the following question:

2. The Portfolio Loss and the Borrowing Costs claims have not

Further, the assessment of the Portfolio Loss and the Borrowing Costs is not an exact science but necessarily involves some exercise of judgement or discretion by the Panel, and the adoption of certain assumptions.

324- وذكرت الكويت أيضاً أن من شأن منح فائدة على تعويض دُفع فيما يتعلق بخسائر الحافظة وتكاليف الاقتراض أن يعوض عن تأخر العراق في دفع تعويض عن خسائر الحافظة وتكاليف الاقتراض.

While noting that the Portfolio Loss claim is made for lost profits, or loss of return on income-producing assets, Kuwait acknowledged at the oral proceedings that the amount of Funds Raised necessarily would have been lower had compensation been paid for the underlying losses at the time at which the losses were sustained.
322- وفيما أشارت الكويت إلى أن المطالبة المتعلقة بخسائر الحافظة قُدمت عن الكسب الفائت أو العائد الفائت عن الأصول المدرة للدخل، فقد اعترفت في الإجراءات الشفوية بأن مبلغ الأموال المجمعة كان سيكون أقل بالضرورة لو أن التعويض عن الخسائر الأصلية قد دُفع في الوقت الذي تُكبدت فيه الخسائر.

The Panel does not recommend any compensation to be paid in respect of the elements of the Portfolio Loss and the Borrowing Costs claims that arose from the funding of expenditure beyond the funding of direct losses.

327- وذكر العراق أيضاً أن الحكومة لم تتكبد أي خسارة أو خسائر بالإضافة إلى الخسائر التي يمكن التعويض عنها بمنح تعويض فيما يتعلق بمطالبة أصلية وفائدة على هذا التعويض، وأن أي حكم بمنح فائدة، إذا ما تقرر منح تعويض فيما يتعلق بمطالبتي خسائر الحافظة وتكاليف الاقتراض، سيؤدي إلى إفراط في التعويض.
