21. According to the Constitution the Republic of Croatia is a sovereign, democratic and social state in which human rights and basic freedoms are protected based on the principles of equality before the law and non-discrimination and equality of genders.

In the landmark case, Attorney-General versus Susan Kigula and 417 Others, Constitutional Appeal no.3 of 2006, the Supreme Court held that various provisions of the laws of Uganda which prescribed a mandatory death sentence were inconsistent with the Constitution insofar as they were contrary to the principles of equality before the law and of fair trial.
