With regard to the alleged violation of article 14, since the subject of the communication is not a criminal matter, the claim is incompatible ratione materiae with the Covenant.

5.2 With regard to the alleged violation of article 14, the State party further points out that the author was given, at her request, copies of the documents underlying the official report.

4.3 With regard to the alleged violation of article 14, paragraph 2, of the Covenant, the State party points out that the High Court judgement indicated that all the evidence submitted was examined.

7.5 With regard to the alleged violation of the presumption of innocence, the State party puts forward three counter-arguments.

The Committee therefore considers that an application for amparo could not be effective with regard to the alleged violation of article 14, paragraph 5, of the Covenant, and that the author had exhausted domestic remedies in respect of the alleged violation.

4.4 With regard to the alleged violation of article 27, the State party argues that this claim is manifestly illfounded within the meaning of article 2 of the Optional Protocol.

6.4 With regard to the alleged violation of article 14, paragraph 5, it transpires from the text of the Supreme Court judgement that the Court dealt extensively with the assessment of all the evidence by the court of first instance.

5.2 With regard to the alleged violation of article 15 of the Covenant, the author claims that, by judging his acts, the State party's courts deprived the relevant GDR legislation of its original meaning, replacing it by their own concept of justice.

4.10 With regard to the alleged violation of article 26 of the Covenant, the State party denies that the author has been subjected to discriminatory treatment.

4.10 With regard to the alleged violation of article 26 of the Covenant, the State party denies that the author has been subjected to discriminatory treatment.

With regard to the alleged violation of the minor's right to privacy, the Court held that since the argument had not been raised at the cassation stage it was inadmissible on account of the subsidiary nature of the amparo application.
وفيما يتعلق بادعاء انتهاك حق الطفلة في الحياة الخاصة والشخصية، اعتبرت المحكمة أن هذه الحجة لم تقدم في طلب النقض، الأمر الذي يجعلها غير مقبولة بالنظر إلى الطابع الفرعي لطلب الحماية المؤقتة.

3.7 As to the admissibility of the communication, the author contends that he has exhausted all available domestic remedies and that he has no other effective remedy under the country's legal system with regard to the alleged violation of his rights.
3-7 وفيما يتعلق بمقبولية البلاغ، يؤكد صاحب البلاغ أنه استنفد جميع سبل الانتصاف المحلية المتاحة وليس لديه سبيل آخر فعال للانتصاف بموجب النظام القانوني للبلد فيما يتعلق بادعاء انتهاك حقوقه.

With regard to the alleged violation of article 9, paragraph 1, of the Covenant, the State party claims that the author's complaint refers to the application of prison privileges, the granting or denial of which does not call into question the fact that he was obliged to serve the three-year prison sentence that had been lawfully imposed upon him.
وفيما يتعلق بزعم انتهاك الفقرة 1 من المادة 9 من العهد، تؤكد الدولة الطرف أن شكوى صاحب البلاغ تشير إلى تطبيق تدابير مخففة في السجن، وهي تدابير لا يؤدي منحها أو رفضها إلى تعديل حقيقة التزامه بأداء عقوبة بالسجن مفروضة عليه قانوناً لمدة ثلاث سنوات.

16.8 With regard to the alleged violation of article 14 of the Convention, the Committee notes the complainant's allegations that the State party has deprived him of any form of redress by failing to act on his complaint and by not immediately launching a public investigation.
16-8 وفيما يتعلق بالانتهاك المدعى للمادة 14 من الاتفاقية، تحيط اللجنة علماً بادعاءات صاحب الشكوى بأن الدولة الطرف حرمته من أي سبيل للانتصاف، بعدم بحث شكواه ولأنها لم تجر أي تحقيق عام فوراً.

8.10 With regard to the alleged violation of article 17, the Committee notes that the State did not provide any justification or clarification as to the entrance of law enforcement officials into the Mezine family home in the middle of the night at 2 a.m. without producing a warrant.
8-10 وفيما يتعلق بمزاعم انتهاك المادة 17، تلاحظ اللجنة أن الدولة الطرف لم تقدم أية معلومات تبرر أو تفسر اقتحام رجال قوات الأمن بيت أسرة مزين في جنح الليل، على الساعة الثانية صباحاً، دون أمر قضائي.

4.5 With regard to the alleged violation of article 26, the State party contends the communication is inadmissible ratione materiae, or, in the alternative, does not constitute a violation.
4-5 وفيما يخص الانتهاك المزعوم للمادة 26 تحاجج الدولة الطرف بأن البلاغ غير مقبول بحكم طبيعة المسألة المطروحة، أو إذا كان مقبولاً فإنه لا يشكل انتهاكاً.

With regard to the alleged violation of article 14, paragraph 1, the Committee notes that this issue was not raised in the appeal (cassation) in the Supreme Court.
وفيما يتعلق بإدعاء انتهاك الفقرة 1 من المادة 14، تلاحظ اللجنة أن هذه المسألة لم تُثر في الاستئناف (النقض) المقدم إلى المحكمة العليا.

7.4 With regard to the alleged violation of article 9, the Committee notes the State party's argument that the author knew the reasons for his arrest, as it was thanks to his testimony that the holder of the stolen goods could be identified.
7-4 وفيما يتعلق بادعاءات انتهاك المادة 9 من العهد، تحيط اللجنة علماً بحجة الدولة الطرف التي تؤكد أن صاحب البلاغ كان على علم بأسباب إلقاء القبض عليه لأن شهادته هي التي أدت إلى تحديد هوية الشخص الذي كانت السلع المسروقة بحوزته.

8.5 With regard to the alleged violation of article 10 of the Covenant, the Committee notes that, according to the author, Ali Benhadj was subjected to physical abuse on several occasions during his detention and that he was held on death row for several months.
8-5 وفيما يتعلق بالادعاء بانتهاك المادة 10 من العهد، ترى اللجنة أن علي بن حاج تعرض، حسبما ذكر صاحب البلاغ، لاعتداءات جسدية عدة مرات أثناء اعتقاله وأنه احتجز لعدة شهور في جناح المحكوم عليهم بالإعدام.

In the case under examination, the Committee considers that the remedy of amparo had no prospect of success with regard to the alleged violation of article 14, paragraph 5, of the Covenant.
وفي هذه القضية، ترى اللجنة أن اللجوء إلى سبيل الانتصاف المتمثل في رفع دعوى لإنفاذ الحقوق الدستورية كان من المستبعد نجاحه فيما يتعلق بانتهاك الفقرة 5 من المادة 14 من العهد.

It adds that the communication is incompatible with the Covenant with regard to the alleged violation of articles 16, 23 and 26 and that these parts of the communication should therefore be found inadmissible ratione materiae under article 3 of the Optional Protocol.
