The principle, enshrined in paragraph 10 of article 16, requires that where extradition is refused solely on the ground of nationality, the requested State Party will be ready to prosecute the person in his or her own territory.

2. If the request for extradition includes several separate serious crimes, some of which are not covered by this article, the requested State Party may apply this article also in respect of the latter offences.

Where the requested State Party identifies problems with the execution of a request pursuant to this subparagraph it shall, without delay, consult with the Court to resolve the matter.
وعندما تبين الدولة الطرف الموجه إليها الطلب وجود مشاكل تتعلق بتنفيذ الطلب بموجب هذه الفقرة الفرعية، تتشاور مع المحكمة دون تأخير من أجل حل هذه المسألة.

The requested State Party shall respond to reasonable requests by the requesting State Party on progress of its handling of the request.

6. Extradition shall, in all cases, be subject to the conditions provided for by the law of the requested State Party or by applicable extradition treaties, including, in particular, conditions relating to the minimum penalty requirement for extradition and the grounds upon which the requested State Party may refuse extradition or make it subject to certain conditions.
6 - يخضع التسليم، في جميع الحالات، للشروط المحددة في قانون الدولة الطرف المطلوب منها التسليم أو في معاهدات التسليم السارية بما فيها، بوجه خاص، الشروط المتعلقة بالحد الأدنى للعقوبة الموجبة للتسليم والأسباب التي تجيز للدولة الطرف المطلوب منها التسليم رفض هذا التسليم، أو إخضاعه لبعض الشروط.

If the request cannot be executed without breaching the requested confidentiality, the central authority of the requested State Party shall so inform the requesting State Party, which shall then determine whether the request should nevertheless be executed.
وإذا استحال تنفيذ الطلب دون انتهاك السرية المطلوبة، تقوم السلطة المركزية للدولة الطرف الموجه إليها الطلب بإشعار الدولة الطرف الطالبة بالأمر، التي تقرر عندئذ إذا كان من المناسب تنفيذ الطلب على الرغم من ذلك.

Some speakers noted that requests for extradition were often denied without an explanation from the requested State, although article 16, paragraph 16, of the Convention indicated that, before refusing extradition, the requested State Party should, where appropriate, consult with the requesting State party, so as to allow it to provide relevant information.
108- وذكر بعض المتكلّمين أنَّ طلبات تسليم المجرمين كثيراً ما تُرفَض دون أن تقدِّم الدولة متلقِّية الطلب إيضاحاً بهذا الشأن، مع أنَّ الفقرة 16 من المادة 16 من الاتفاقية تشير إلى أنه يتعيّن على الدولة الطرف متلقِّية الطلب، قبل أن ترفض التسليم، أن تتشاور مع الدولة الطرف الطالبة عند الاقتضاء لكي يتسنّى لها تقديم المعلومات ذات الصلة.

In such a case the requested State Party shall advise the requesting State Party accordingly.
وفي هذه الحالة ينبغي للدولة متلقية الطلب أن تخبر الدولة الطرف الطالبة بذلك.

6. If extradition for an offence to which this article applies is refused solely on the basis of the nationality of the person sought, the requested State Party shall submit the case to its competent authorities for the purpose of prosecution under the criteria, laws, and procedures applied by the requested State to those offences when they are committed in its own territory.
6 - إذا لم يوافق على التسليم عن جريمة تنطبق عليها هذه المادة بناء على جنسية المطلوب تسليمه فقط، تقوم الدولة الطرف الموجه إليها طلب التسليم بعرض القضية على سلطاتها المختصة بغرض المحاكمة وفقا للمعايير والتشريعات والإجراءات التي تطبقها الدولة الموجه إليها طلب التسليم على تلك الجرائم حينما ترتكب خارج إقليمها.

2. Proceedings are pending in the requested State Party: If a prosecution in respect of the offence for which extradition is requested is pending in the requested State Party against the person whose extradition is requested.
