The decision directs Mr. Ruto to sign a waiver in respect of his right to be present during trial and sets out a list of stages during which he is required to be present.

32. On 18 June 2013, the Chamber issued a decision exempting Mr. Ruto from continuous presence during the trial owing to his duties as Deputy President of Kenya.

1. Requests the International Criminal Court to defer the investigation and prosecution against President Uhuru Muigai Kenyatta and Deputy President William Samoei Ruto for a period of 12 months, in accordance with article 16 of the Rome Statute of the Court;

47. On 25 October 2013, the Appeals Chamber reversed the previous decision of Trial Chamber V (a) to grant Mr. Ruto conditional excusal from continuous presence at trial.

However, on 15 January 2014, following the introduction of the new rule 134 quater to the Court's rules of procedure and evidence, adopted in November 2013 by the Assembly of States Parties, Trial Chamber V (a) decided in an oral ruling to conditionally excuse Mr. Ruto from presence at trial.
غير أن الدائرة الابتدائية الخامسة (أ)أصدرت في 15 كانون الثاني/يناير 2014قرارا شفهيا بإعفاء السيد روتو من حضور جلسات المحاكمة بشكل مشروط، بعد أن بدأت المحكمة في تطبيق المادة 134 مكررا ثالثا الجديدة من القواعد الإجرائية وقواعد الإثبات، التي اعتمدتها جمعية الدول الأطراف في تشرين الثاني/نوفمبر 2013.

The Appeals Chamber found that, while article 63 (1) of the Rome Statute did not operate as an absolute bar in all circumstances to the continuation of trial proceedings in the absence of the accused, Mr. Ruto's absence could only be in exceptional circumstances and must not become the rule.
وارتأت دائرة الاستئناف أنه رغم كون المادة 63 (1) من نظام روما الأساسي لا تحظر بشكل مطلق استمرار إجراءات المحاكمة في غياب المتهم، فإنه لا يجوز التصريح بغياب السيد روتو إلا في الظروف الاستثنائية ويجب ألا يصبح غيابه هو القاعدة.
