The commentary to draft article 1 erroneously suggests that the descriptor " between States " refers to treaties, whereas it obviously refers to hostilities. (see also the comments on draft article 2 below.)

In this connection, the Committee expects the Secretary-General to clearly distinguish in all budgetary proposals between requirements for the armed guards provided by police- and troop-contributing countries and those obtained from private security companies, as appropriate (see also the comments of the Committee on the use of United Nations guards in special political missions in section III above) (para. 180).

The Board was not able to validate this by 20 May 2005, and is not in a position to verify statement made by UNOPS regarding the provision of $2.8 million, since the most recent budget revisions had not been approved as at May 2005. (see also the comments of the Board in paragraph 627 above.)

The Committee was informed, for example, that an international company based in Nairobi could offer medical evacuation at a reasonable price, whereas the Mission uses two aircraft under letter-of-assist arrangements for this purpose. As indicated in the performance report for 2002/03, the actual cost per rotation was $4,418, as compared with the budgeted amount of $8,200 (see A/58/633, para. 7; see also the comments of the Committee on this matter in A/57/772/Add.8, para. 20).

The inclusion of internal armed conflicts in the draft articles would undermine such procedural safeguards adopted in the Convention. (see also the comments on draft article 1 above.)
