وتستخدم في انشاء التوقيع الرقمي نتيجة بعثرة مشتقة من الرسالة الموقعة ومفتاح خصوصي معين وتكون متعلقة بهما دون سواهما؛

1. Where signature creation data can be used to create a signature that has legal effect, each signatory shall:
1 - حيثما أمكن استخدام بيانات إنشاء التوقيع لإنشاء توقيع ذي مفعول قانوني، يتعين على كل موقِّع:

in any case, the link between the signatory and the signature creation data.
`2` في أي حالة، الصلة بين الموقّع وبيانات انشاء التوقيع.

(i) the signatory knows that the signature creation data have been compromised; or
`1 ' معرفة الموقِّع بأن بيانات انشاء التوقيع تعرضت لما يثير الشبهة؛ أو

(ii) the circumstances known to the signatory give rise to a substantial risk that the signature creation data may have been compromised;
`2 ' كون الظروف المعروفة لدى الموقِّع تؤدي الى احتمال كبير بأن بيانات انشاء التوقيع ربما تكون قد تعرضت لما يثير الشبهة؛

(ii) that the signatory that is identified in the certificate had control of the signature creation data at the time when the certificate was issued;
`2 ' أن الموقّع المعينة هويته في الشهادة كان يسيطر على بيانات انشاء التوقيع في الوقت الذي أصدرت فيه الشهادة؛

(iii) that signature creation data were valid at or before the time when the certificate was issued;
`3 ' أن بيانات انشاء التوقيع كانت صحيحة في الوقت الذي أُصدرت فيه الشهادة أو قبله؛

(ii) any limitation on the purpose or value for which the signature creation data or the certificate may be used;
`2 ' وجود أي قيد على الغرض أو القيمة التي يجوز أن تستخدم من أجلها بيانات انشاء التوقيع أو أن تستخدم من أجلها الشهادة؛

(iii) that the signature creation data are valid and have not been compromised;
`3 ' أن بيانات انشاء التوقيع صحيحة ولم تتعرض لما يثير الشبهة؛

After discussion, the Working Group decided that, for lack of a better term, the term " signature creation data " should be used.

General preference was expressed for not having the definition and relying on draft article 6 to express the idea that the signature creation data should be linked to the signatory and to no other person.

It was pointed out that a certification service provider could only be expected to state the identity of the holder of the signature creation device, but had no means of establishing whether that person was in fact in control of the signature creation data at the time of signing.

' 2` كون الظروف المعروفة لدى الموقِّع تؤدي إلى نشوء احتمال قوي بتعرض بيانات إنشاء التوقيع لما يثير الشبهة؛

(ii) That the signatory that is identified in the certificate had control of the signature creation data at the time when the certificate was issued;
' 2` أن الموقّع المعيّنة هويته في الشهادة كان يسيطر على بيانات إنشاء التوقيع في وقت إصدار الشهادة؛

" Signatory " means a person that holds signature creation data and acts either on its own behalf or on behalf of the person it represents;
(د) " موقّع " يعني شخصا حائزا على بيانات انشاء توقيع ويتصرف اما بالاصالة عن نفسه أو بالنيابة عن الشخص الذي يمثله؛

In that context, the view was expressed that the guide should refer consistently to " signature creation data " and not to " signature device " .
وفي هذا السياق، أعرب عن الرأي أنه ينبغي الإشارة في الدليل دائما إلى " بيانات إنشاء التوقيع " وليس " أداة التوقيع " .

(a) Exercise reasonable care to avoid unauthorized use of its signature creation data;

While it was generally agreed that the notion of " signature creation data " should be used throughout the text as a self-explanatory notion, a question was raised as to whether the reference in draft article 6(3) to " the means of creating the electronic signature " should be replaced by a reference to " the signature creation data " .
ومع أنه كان من المتفق عليه بوجه عام أن مفهوم " بيانات انشاء التوقيع " ينبغي أن يستخدم في كل النص كمفهوم يفسر ذاته، أثير سؤال بشأن ما اذا كان ينبغي أن يستعاض عن الاشارة في مشروع المادة 6 (3) الى " الوسيلة المستخدمة لانشاء التوقيع الالكتروني " باشارة الى " بيانات انشاء التوقيع " .
