Since a State's right to grant nationality was virtually absolute, the main clause of draft article 5 should read " the State of nationality means the State whose nationality the individual sought to be protected has acquired in accordance with its national laws " .

On the facts, the Loewen case dealt with the situation in which the person sought to be protected changed nationality after the presentation of the claim to that of the respondent State, in which circumstances a claim for diplomatic protection can clearly not be upheld, as is made clear in draft article 5, paragraph (4).
