According to article VIII, paragraph 1, of the Convention, parties shall take in their domestic legislation appropriate measures to enforce the provisions of the Convention and prohibit trade in specimens in violation thereof, including measures: (a) to penalize trade in, or possession of, such specimens, or both; and (b) to provide for the confiscation or return to the State of export of such specimens.

The secured creditor is entitled to take possession of the encumbered asset without applying to a court or other authority if: (i) it has given the grantor and any person in possession of the encumbered asset notice of default and (ii) possession can be taken without the use or threat of force.
يحقّ للدائن المضمون أن يحوز الموجودات المرهونة دون اللجوء إلى محكمة أو سلطة أخرى إذا: `1` وجّه إلى المانح أو أي شخص حائز للموجودات المرهونة إشعارا بالتقصير و`2` تسنّى الحصول على الحيازة دون استعمال القوة أو التهديد باستعمالها.

As already noted, most States have mandatory rules that require secured creditors in possession to take reasonable care of, to preserve and to maintain the encumbered assets in their possession.

in line with the above considerations, the Guide recommends that States enact a general mandatory pre-default rule imposing a duty on parties in possession to take reasonable care to preserve encumbered assets (see recommendation 107).
