Another criticism was that the threshold for termination of the concession contract was said to be lower than the threshold for temporary takeover of an infrastructure project by the contracting authority under draft model provision 41, which was only possible in case of " serious failure " by the concessionaire to deliver the public service.
ووجّه انتقاد آخر مفاده أن المنطلق في حالة إنهاء عقد الامتياز أدنى من المنطلق المنصوص عليه في حالة تولي السلطة المتعاقدة مشروع البنية التحتية بموجب مشروع الحكم النموذجي 41، وهو اجراء لا يمكن اتخاذه إلا في حالة " حدوث تخلّف خطير " من جانب صاحب الامتياز عن توفير الخدمة العامة.

The contracting authority may agree with the entities extending financing for an infrastructure project on the substitution of the concessionaire by a new entity or person appointed to perform under the existing concession contract upon serious breach by the concessionaire or other events that could otherwise justify the termination of the concession contract or other similar circumstances.
يجوز للسلطة المتعاقدة أن تتفق مع الكيانات التي تموّل مشروعا من مشاريع البنية التحتية على الاستعاضة عن صاحب الامتياز بكيان أو شخص جديد يعين للتنفيذ بموجب عقد الامتياز القائم عند حصول إخلال جسيم من جانب صاحب الامتياز أو وقوع أحداث أخرى يمكن أن تبرر إنهاء عقد الامتياز أو ظروف أخرى مماثلة.()
