Therefore, the Committee considers that the complainant has not substantiated his claim that he was personally at a real risk of being subjected to torture, if returned to Sri Lanka.
وعليه، فإن اللجنة ترى أن مقدم الشكوى لم يثبت صحة دعواه بأنه سيكون شخصياً في خطر حقيقي لأن يتعرض للتعذيب إذا عاد إلى سرى لانكا.

The State party objects to admissibility on the grounds that the complainant has not established a prima facie case of a violation of article 3, but the Committee is of the view that the author has provided sufficient information in substantiation of his claim to consider his complaint on the merits.
وتعترض الدولة الطرف على مقبولية الشكوى على أساس أن الشاكي لم يثبت ظاهراً انتهاك المادة 3، غير أن اللجنة ترى أن صاحب البلاغ قدم معلومات كافية لدعم مطالبته بالنظر في شكواه على أسس موضوعية.

Lastly, the Committee notes the State party's assertion that the complainant has not substantiated his political activities in Switzerland and that nothing indicates that such activities have been brought to the attention of the Congolese authorities.
وتلاحظ كذلك تأكيد الدولة الطرف بأن صاحب البلاغ لم يثبت أنشطته السياسية التي يقوم بها في سويسرا وأنه لا يوجد دليل على أن السلطات الكونغولية قد تكون على علم بهذه الأنشطة.

6.2 As regards the complainant's claim that she has adduced written evidence in support of her claims, the State party recalls that the complainant has not submitted any documents to substantiate her alleged membership of the parish.
6-2 وفيما يخص ادعاء صاحبة الشكوى أنها قدمت أدلة خطية لدعم ادعاءاتها، تذكر الدولة الطرف بأن صاحبة الشكوى لم تقدم أية وثائق لإثبات عضويتها المزعومة في الأبرشية.

Accordingly, the State party submits that the complainant has not exhausted all available domestic remedies and that the complaint should be declared inadmissible in accordance with article 5, paragraph 2, of the Optional Protocol to the CCPR.
وبناء عليه، تدفع الدولة الطرف بأن مقدّم الشكوى لم يستنفد جميع سبل الانتصاف المحلية المتاحة وبأنه ينبغي إعلان عدم مقبولية الشكوى وفقاً للفقرة 2 من المادة 5 من البروتوكول الاختياري للعهد الدولي الخاص بالحقوق المدنية والسياسية().

5.3 The State party submits that the complainant has not provided any details or corroborating evidence such as medical reports or scarring of his alleged torture by the Military Security Police in 1992, and thus certainly not in any recent past.
5-3 وتقول الدولة الطرف إن صاحب البلاغ لم يقدم أي تفاصيل أو أدلة داعمة كتقارير طبية أو آثار للجروح الناجمة عن تعذيبه المزعوم على أيدي شرطة الأمن العسكري في عام 1992، وهو ما يعني بالتأكيد أن ذلك لم يحدث في ماضٍ قريب.

4.13 Should the Committee find the complaint admissible, the State party argues that the complainant has not established that her return to Sri Lanka would constitute a violation of article 3 of the Convention.
4-13 وعلى افتراض أن اللجنة خلصت إلى أن الشكوى مقبولة، تقول الدولة الطرف إن صاحبة الشكوى لم تثبت أن إعادتها إلى سري لانكا سوف تنتهك المادة 3 من الاتفاقية.

11. On the basis of the above considerations, the Committee considers that the complainant has not substantiated her claim that she risks being subjected to torture upon return to Georgia.
11- وترى اللجنة بالاستناد إلى الاعتبارات السالفة الذكر، أن مقدمة الشكوى لم تثبت بالأدلة ادعاءها أنها تواجه خطر التعرض للتعذيب لدي عودتها إلى جورجيا.

4.14 The State party concludes that the communication is without foundation, and that the complainant has not demonstrated a violation of articles 3 and 16 of the Convention.
4-14 وتخلص الدولة الطرف إلى أن البلاغ لا يستند إلى أي أساس صحيح وأن صاحب الشكوى لم يثبت حصول انتهاك للمادتين 3 و16 من الاتفاقية.
