In many resolutions, the United Nations had condemned the establishment of Israeli settlements and had reaffirmed that the Geneva Convention relative to the Protection of Civilian Persons in Time of War was applicable to occupied Palestinian territories, including Jerusalem, and to the Arab territories occupied by Israel since 1967.
وإن جميع هذه القرارات تؤكد على انطباق اتفاقية جنيف المتعلقة بحماية المدنيين وقت الحرب لعام ١٩٤٩، على اﻷراضي الفلسطينية المحتلة بما فيها القدس واﻷراضي العربية اﻷخرى التي تحتلها اسرائيل منذ عام ١٩٦٧.

وصرحت اسرائيل بأن اتفاقية جنيف المتعلقة بأسرى الحرب لا تنطبق على الفلسطينيين ﻷنهم ليسوا جنودا نظاميين وﻷنهم قاموا بمهاجمة المدنيين بصورة رئيسية.
