وأفادت المعلومات الواردة أن محكمة أمن الدولة في اسطنبول أصدرت في أواخر عام ٥٩٩١ حكماً بالسجن لمدة عشرة أشهر على جريمة " النزعة الانفصالية " بموجب المادة ٨ من قانون مكافحة اﻹرهاب.

On 9 October 1996 the Government informed the Special Rapporteur that in accordance with changes that had been made to article 8 of the Anti-Terror Law calling for the revision of sentences passed under its former provisions, 269 persons had been released and 1,408 persons had seen their sentences reduced.
٧٩١- وفي ٩ تشرين اﻷول/أكتوبر ٦٩٩١، أبلغت الحكومة المقرر الخاص أنه بموجب التغييرات التي أُدخلت على المادة ٨ من قانون مكافحة اﻹرهاب وتدعو إلى إعادة النظر في أحكام صدرت بموجب اﻷحكام السابقة لهذه المادة، أُطلق سراح ٩٦٢ شخصاً وخُففت اﻷحكام الصادرة بحق ٨٠٤ ١ أشخاص.

وأوضحت الحكومة أن التعديلات التي أُدخلت على قانون مكافحة اﻹرهاب قد غيرت جوهر وضيﱠقت نطاق الجريمة المنصوص عليها في المادة ٨، فجعلت من الممكن للقضاة أن يوقعوا غرامات بدلاً من أحكام السجن عند التذرع بتلك المادة.

In addition, Decree 285 reportedly modifies the Anti-Terror Law in areas where a state of emergency is in force, stating that the decision to prosecute members of the security forces is not the competence of the public prosecutor but of local administrative councils, which are made up of civil servants reportedly with no legal education and under the influence of the regional or provincial governor, who is also the head of the security forces.
وتنتقل في حالة الطوارئ بموجب المرسوم رقم ٥٨٢ سلطة محاكمة أفراد قوات اﻷمن المقررة في قانون مكافحة اﻹرهاب للنيابة العامة إلى المجالس اﻹدارية المحلية التي تتألف طبقا للتقارير من موظفين مدنيين غير مؤهلين قانونياً وخاضعين لسيطرة حكام اﻷقاليم أو المقاطعات الذين يرأسون قوات اﻷمن أيضا.

He was reportedly convicted under Article 8 of the Anti-Terror Law (Law 3713) and was currently being held in Saray Prison, near Tekirdag.

In particular, please clarify how article 15 of the Anti-Terror Law relating to “faceless judges” and article 6 of the Treason Law relating to secret military tribunals are implemented; whether confessions or testimony obtained under duress can be used before military courts; and whether these procedures are compatible with article 14 of the Covenant (see paras. 219-233 of the report).
