324. The Committee notes with satisfaction that the Covenant has been incorporated into domestic law and can be invoked in the country's courts.
324- تلاحظ اللجنة بارتياح أن العهد قد أُدرج في القوانين المحلية ويمكن الاحتجاج به أمام محاكم البلد.

All individuals subject to its jurisdiction have the right to submit a written communication to the Committee on Civil and Political Rights if they consider that any of their rights enumerated in the Covenant has been violated and they have exhausted all available domestic remedies.
ويحق لأي شخص خاضع لولايتها أن يوجه بلاغاًً كتابياً إلى اللجنة المعنية بحقوق الإنسان لدى منظمة الأمم المتحدة إذا ما رأى أن حقاً من الحقوق التي يكفلها له العهد قد انتُهك وأن جميع سبل الانتصاف الداخلية المتاحة له قد استُنفدت.

3.3 The author further alleges that article 26 of the Covenant has been violated in his case.

In the present case, since the final sentence of death was passed without having observed the requirements of article 14 concerning fair trial and presumption of innocence it must be concluded that the right protected by article 6 of the Covenant has been violated.
وفي هذه القضية، فإنه لما كان الحكم النهائي باﻹعدام قد صدر دون مراعاة اشتراطات المادة ١٤ بشأن المحاكمة العادلة وافتراض البراءة، فإنه لا بد من الخلوص إلى أن الحق الذي تحميه المادة ٦ من العهد قد انتهك.

وفي القضية الراهنة فبما أن الحكم النهائي باﻹعدام قد صدر دون مراعاة لمقتضيات التمثيل الفعال في الاستئناف على النحو المحدد في المادة ١٤، يجب استنتاج أن الحق الذي تحميه المادة ٦ من العهد قد انتهك.

In the present case, since the final sentence of death was passed without having observed the requirement for a fair trial set out in article 14, it must be concluded that the right protected by article 6 of the Covenant has been violated.
وفي هذه القضية فإنه لما كان الحكم النهائي باﻹعدام صدر دون مراعاة لمقتضيات المحاكمة العادلة المنصوص عليها في المادة ١٤ يجب استنتاج أن الحق الذي تحميه المادة ٦ من العهد قد انتهك.

In view of constraints relating to the level of the country's economic and social development, even though the Covenant has come into force in China, not all its articles have been fully realized.

وفيما يتعلق بإيقاف مشاركة صاحب البلاغ في التجربة السريرية، تكرر الدولة الطرف ملاحظاتها السابقة، وتؤكد أن حقوق صاحب البلاغ بموجب المادتين 7 و10 من العهد لم تُنتهك.

10. The Committee regrets that the Covenant has not been incorporated into domestic law and therefore cannot be directly invoked before the domestic courts.
10- وتأسف اللجنة لعدم إدراج العهد حتى الآن في القانون المحلي مما يحول دون الاستشهاد به مباشرة في المحاكم المحلية.

The State party maintains that no violation of the author's rights under the Covenant has taken place.
وتؤكِّد الدولة الطرف أنّه لم يُرتكب أيّ انتهاك لحقوق صاحب البلاغ المنصوص عليها في العهد.

6. The Committee notes that, according to the State party's report, the Covenant has primacy over national law and may be invoked in the State party's courts.
6- تلاحظ اللجنة، استناداً إلى تقرير الدولة الطرف، أن للعهد الأسبقية على القانون الوطني وأنه يجوز الاحتجاج بأحكامه أمام محاكم الدولة الطرف.

The Committee notes that under the revised Constitution of 1996 the Covenant has priority over national law, and welcomes the statement of the delegation that Covenant rights can be invoked directly in Cameroonian courts, and that these apply the provisions of the Covenant.
185- تلاحظ اللجنة أنه بموجب الدستور المنقح لعام 1996 يكون للعهد الأولوية على القانون الوطني، وترحب بتصريح الوفد أنه يجوز الاحتجاج مباشرة بالحقوق المنصوص عليها في العهد في المحاكم الكاميرونية، وأن هذه المحاكم تطبق أحكام العهد.

The Committee is concerned that the Covenant has not been given full effect in the State party's domestic legal order.
7- يساور اللجنة القلق لعدم إدراج جميع أحكام العهد بشكل كامل في النظام القانوني المحلي للدولة الطرف.

Despite assurances that the Covenant has constitutional status and is therefore directly invocable in courts, the Committee notes that it has been further described by the State party as being applied in a manner which is " complementary " to the Constitution, without further precision concerning that term.
ورغم التأكيدات بأن العهد يتمتع بمركز دستوري وبالتالي يرجع إليه في المحاكم رجوعاً مباشراً، تلاحظ اللجنة أن الدولة الطرف ذكرت كذلك أن تطبيق العهد يأتي " مكملاً " للدستور، دون تقديم تفسير آخر دقيق لما تعنيه هذه العبارة.
