6. The travaux préparatoires should indicate that when the domestic law of a State Party requires the order of a court for confiscation, that court will be considered the only competent authority for the purposes of this definition.
6- ينبغي أن يذكر في " الأعمال التحضيرية " أنه عندما يشترط القانون الداخلي للدولة الطرف، لاجراء المصادرة، وجود أمر صادر عن محكمة، يتعين اعتبار تلك المحكمة هي السلطة المختصة الوحيدة لأغراض هذا التعريف.

Several delegations expressed their concern about the reference to implementation “subject to” the provisions of the domestic law of a State Party.
وأبدت عدة وفود قلقها ازاء الاشارة الى التنفيذ " رهنا بـ " أحكام القانون الداخلي للدولة الطرف .

As for immunity ratione materiae, his delegation wished to emphasize that international law must recognize the immunity granted by the domestic law of a State to government agents or law enforcement officials for acts undertaken to maintain law and order but without the intent to commit human rights violations.

7- ليس في هذه الاتفاقية ما يمس بالمبدأ القائل بأن توصيف الأفعال المجرَّمة وفقا لهذه الاتفاقية وتوصيف الدفوع القانونية المنطبقة أو المبادئ القانونية الأخرى التي تحكم مشروعية السلوك، محفوظ حصرا للقانون الداخلي للدولة الطرف وبوجوب ملاحقة تلك الجرائم والمعاقبة عليها وفقا لذلك القانون.
