وتضيف أن القانون الجزائري لا يتضمن أي حكم يمنع استخدام الاعترافات أو الإفادات التي تنتزع تحت التعذيب كأدلة، وهو ما لا يساعد على ردع أفراد الشرطة القضائية، ومن باب أفراد مصالح مديرية الاستخبارات والأمن - الذين لا يتبعون السلطة القضائية، عن اللجوء إلى أساليب غير مشروعة للحصول على إفادات تستخدم لاحقاً في المحاكمات الجنائية ضد المحتجزين أو ضد أطراف ثالثة.

14. While noting the State party's assertion that the state of emergency does not entail any restriction on most rights and freedoms, the Committee is nevertheless concerned that the state of emergency proclaimed in Algeria in 1992 has remained in force since then, as evidenced, for instance, by the continued delegation of the functions of the police to the Intelligence and Security Department.
14- وإذ تحيط اللجنة علماً ببيانات الدولة الطرف التي قالت فيها إن حالة الطوارئ لا تتسبب في إعاقة التمتع بمعظم الحقوق والحريات، يساورها القلق مع ذلك إذ إن حالة الطوارئ، التي فرضت في الجزائر في عام 1992، لا تزال سارية المفعول منذ ذلك التاريخ وأنها تتجلى دائماً بمظاهر مثل إسناد مهام الشرطة القضائية إلى مديرية الاستخبارات والأمن.

2.4 Eight months after the arrest, the author learned from a former detainee that her husband was being held at the Mansourah barracks, in the 5th military region, which is run by the Intelligence and Security Department (DRS).
