3- تنظر الدول الأطراف في إمكانية منح الحصانة من الملاحقة لأي شخص يقدم عوناً كبيراً في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية، وفقاً للمبادئ الأساسية لقوانينها الداخلية.

2- تنظر كل دولة طرف في إمكانية منح الحصانة من الملاحقة لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية، وفقا للمبادئ الأساسية لقانونها الداخلي.

2. When the Pre-Trial Chamber does not confirm the decision by the Prosecutor referred to in sub-rule 1, he or she shall proceed with the investigation or prosecution.
2 - عندما لا تجيز الدائرة التمهيدية قرار المدعي العام بموجب الفقرة 1 من القاعدة، فإنه يمضي قدما في التحقيق والملاحقة القضائية.

In accordance with the principle of complementarity underlying the Rome Statute, a case is inadmissible before the Court if it is being investigated or prosecuted by a State, unless the State is unwilling or genuinely unable to carry out the investigation or prosecution.

2- يتعين على كل دولة طرف أن تنظر في اتاحة امكانية اللجوء، في الحالات المناسبة، الى تخفيف عقوبة الشخص المتهم الذي يقدم عونا كبيرا في اجراءات التحقيق أو الملاحقة بشأن احدى الجرائم المشمولة بهذه الاتفاقية.

2- تنظر الدول الأطراف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عوناً كبيراً في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

1- تنظر كل دولة طرف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عونا كبيرا في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

73. The relevant authorities may, in the interest of justice, dispense with the investigation or prosecution of a crime punishable under the Act.
73 - ويجوز للسلطات المختصة أن تستغني، لما فيه مصلحة العدالة، عن التحقيق أو المقاضاة في جريمة يعاقب عليها ذلك القانون.

Article 26, paragraphs 2 and 3, encourages States parties to consider mitigating the sentence or granting immunity from prosecution to persons who cooperate with the authorities in the investigation or prosecution of organized crime.
وتشجّع الفقرتان 2 و3 من المادة 26 الدول الأطراف على النظر في منح تخفيف للعقوبة أو منح الحصانة من الملاحقة القضائية للأشخاص الذين يتعاونون مع السلطات في عمليات التحقيق أو الملاحقة القضائية للجريمة المنظمة.
