As pointed out above, the Prosecutor shall be responsible for the retention, storage and security of information and physical evidence in the course of the investigations.
وكما ذُكر أعلاه، فإن المدعي العام مسؤول عن الاحتفاظ بالمعلومات والأدلة المادية التي يتم الحصول عليها أثناء التحقيقات وعن تخزينها وتأمينها.

1. The Prosecutor shall:

٤ - إذا تقرر أن للقضية وجاهتها الظاهرة، يقوم المدعي العام بإعداد عريضة اتهام تتضمن بيانا دقيقا للوقائع وللجريمة، أو الجرائم، التي وجهت للمتهم تهمة ارتكابها طبقا للنظام اﻷساسي.

٢ - على المدعي العام أن يكلف بالحضور الشهود والخبراء الذين وردت اسماؤهم في القائمة التي وجهها إليه المتهم، شهرا على اﻷقل قبل بداية المحاكمة.

At the request of that State, the Prosecutor shall defer to the State's investigation of such persons unless the Prosecutor determines that there has been a total or partial collapse or unavailability of the State's national judicial system, or the State is unwilling or unable genuinely to carry out the investigation and prosecutions.
وبناء على طلب تلك الدولة، يحيل المدعي العام هؤلاء اﻷشخاص لكي تحقق الدولة معهم، ما لم يُقرر المدعي العام أن النظام القضائي الوطني للدولة قد انهار أو لم يعد متوافرا كليا أو جزئيا، أو أن الدولة غير راغبة في الاضطلاع بالتحقيق والمقاضاة على نحو صادق أو غير قادرة على ذلك.
