4.5 The State party argues that the communication is an abuse of the right of submission pursuant to article 3 of the Optional Protocol.

إلا أن البلاغ قد يمثل إساءة استخدام لحقّ تقديم البلاغات عندما يُقدّم بعد خمس سنوات من استنفاد صاحب البلاغ سبل الانتصاف المحلية أو، حسب الانطباق، بعد ثلاث سنوات من اختتام إجراء آخر من إجراءات التحقيق الدولي أو التسوية الدولية، ما لم تكن هناك أسباب تبرر هذا التأخير، مع مراعاة جميع ملابسات البلاغ.

Article 4 allowed for exceptions as provided for in article 3, in the case of a communication that was anonymous, considered to be an abuse of the right of submission or incompatible with the provisions of the Covenant.
