Article 42 of the Turkish Constitution rules that no other language than Turkish can be taught as a mother tongue to Turkish citizens in education and training institutions; it also adjudges that the principles applicable to schools that deliver educational and training activities in a foreign language shall be regulated by law and that the provisions of international agreements are reserved.

It also notes that, in some cases, in particular with regard to education, freedom of expression and the right to enjoy one's own culture and use one's own language, these reservations may have a negative impact on children belonging to ethnic groups which are not recognized as minorities under the Turkish Constitution and the Treaty of Lausanne of 1923, in particular children of Kurdish origin.

(a) The opinion erroneously identifies these courts as " military courts " , although they were of non-military character even before the 1999 modification of the Turkish Constitution: thus, it is incorrect to characterize the change in composition of the State Security Court after the 1999 modification of the Constitution as a " demilitarization " of a " military court " ;
(أ) إن الرأي يعتبر هذه المحاكم، خطأً، " محاكم عسكرية " ، رغم أنها لم تكن ذات طابع عسكري حتى قبل تعديل الدستور التركي عام 1999: لذا فإنه من غير الصحيح وصف التغيير الذي طرأ على تركيبة محكمة أمن الدولة بعد تعديل الدستور عام 1999 بأنه " نزع للصبغة العسكرية " عن " محكمة عسكرية " ؛

Although equality between women and men has been among the basic principles of the Constitution of the Turkish Republic for years, definition of " discrimination against women " is not included in the Turkish Constitution in the way stated by the Convention.
وعلى الرغم من أن المساواة بين المرأة والرجل كانت من بين المبادئ الأساسية لدستور الجمهورية التركية لسنوات فإن تعريف " التمييز ضد المرأة " لم يُدرج في الدستور التركي بنفس الأسلوب الذي حدِّد في الاتفاقية.

9. The Committee encourages the State party to consider withdrawing its reservations to articles 17, 29 and 30 of the Convention in order to provide better protection and opportunities to all groups of children, in particular children of Kurdish origin, who are not recognized as a minority under the Turkish Constitution and the Treaty of Lausanne of 1923.
9- تشجع اللجنة الدولة الطرف على أن تنظر في سحب تحفظاتها على المواد 17 و29 و30 من الاتفاقية توخياً لإتاحة أفضل الحماية والفرص لكافة مجموعات الأطفال، لا سيما الأطفال المتحدرون من أصل كردي، الذين لا يُعترف بهم كأقلية بموجب الدستور التركي ومعاهدة لوزان لعام 1923.

It must be emphasized that article 90 of the Turkish Constitution provides that “International agreements duly put into effect carry the force of law. No appeal to the Constitutional Court can be made with regard to these agreements on the ground that they are unconstitutional.”
ويتعين التشديد على أن المادة 90 من الدستور التركي تنص على أنه " تتمتع الاتفاقات الدولية النافذة حسب الأصول بقوة القانون، ولا يجوز تقديم استئناف إلى المحكمة الدستورية فيما يتعلق بهذه الاتفاقات على أساس أنها غير دستورية " .

Finally, the Government noted that military service as provided for in article 72 of the Turkish Constitution is in conformity with article 4, paragraph 3 (b), of the European Convention on Human Rights and that detention for non-performance of such service is compatible with article 5, paragraph 1, of the European Convention and article 9, paragraph 1, of the International Covenant on Civil and Political Rights.
47- وأخيراً، أشارت الحكومة إلى أن الخدمة العسكرية المنصوص عليها في المادة 72 من الدستور التركي تنسجم مع الفقرة 3(ب) من المادة الرابعة من الاتفاقية الأوروبية لحقوق الإنسان وأن الاحتجاز لعدم أداء هذه الخدمة يتفق مع الفقرة 1 من المادة 5 من الاتفاقية الأوروبية ومع الفقرة 1 من المادة التاسعة من العهد الدولي الخاص بالحقوق المدنية والسياسية.

7.8 The Committee notes that the State party drew attention to other remedies that would have been available of which the author did not make use -- namely review ( " revision of judgement " ), the complaints procedure under article 74 of the Turkish Constitution and a procedure under the Regulation on the Complaints and Applications by Civil Servants.
