" 5. The terms of the volume contract that derogate from this Convention, if the volume contract satisfies the requirements of paragraphs 1 and 2 of this article, apply between the carrier and any person other than the shipper provided that:

If, for example, fewer containers than stated in the volume contract were actually shipped would the volume contract be held to be retroactively void? Further, it was pointed out that any shipper that was dissatisfied with the terms of the volume contract presented always had the right to enter into a transport agreement on standard terms.

2. A person that is not a party to the volume contract is only bound by an exclusive choice of court agreement concluded in accordance with paragraph 1 of this article if:

(b) Contains a prominent statement that there is an arbitration agreement and specifies the sections of the volume contract containing the arbitration agreement.
(ب) يتضمّن بيانا جليا يفيد بأن هناك اتفاق تحكيم ويحدد أبواب العقد الكمي المحتوية على اتفاق التحكيم.

4. When an arbitration agreement has been concluded in accordance with paragraph 3 of this article, a person that is not a party to the volume contract is bound by the designation of the place of arbitration in that agreement only if:
٤- عندما يكون اتفاق التحكيم قد أُبرم وفقا للفقرة ٣ من هذه المادة، لا يكون الشخص الذي ليس طرفا في العقد الكمي مُلزَما بمكان التحكيم المُعَّين في ذلك الاتفاق إلا إذا:

(a) the volume contract contains a prominent statement that it derogates from this Convention;
(أ) يتضمّن العقد الكمي بيانا جليّا بأنه يخرج عن هذه الاتفاقية؛

5. The terms of the volume contract that derogate from this Convention, if the volume contract satisfies the requirements of paragraph 2 of this article, apply between the carrier and any person other than the shipper provided that:
5- إذا كان العقد الكمي يفي بمقتضيات الفقرة 2 من هذه المادة، انطبقت شروط ذلك العقد التي تخرج عن هذه الاتفاقية فيما بين الناقل وأي شخص آخر غير الشاحن، شريطة:

Other views emphasized that the intention of having to meet the conditions outlined prior to being allowed to derogate from the draft instrument was to avoid a situation where the volume contract could be abused to the detriment of one of the parties to it.
وشدّدت آراء أخرى على أن القصد من استيفاء الشروط المحدّدة قبل السماح بالخروج عن أحكام مشروع الصك هو تفادي وضع يمكن فيه اساءة استخدام عقد الحجم على حساب أحد طرفيه.

In view of the absence of an individual contract governing each individual shipment, reference had to be made to those stipulations in the volume contract that governed each individual shipment.
ونظرا لغياب عقد فردي يحكم كل شحنة بمفردها، فقد كان من اللازم الإشارة إلى تلك الاشتراطات في عقد الحجم الذي ينظم كل شحنة بمفردها.

Conversely, the terms or stipulations of the volume contract that did not regulate individual shipments remained outside the scope of application of the draft instrument.
