For both of these groups, it is the primary duty and responsibility of the competent authorities, as reflected in Guiding Principle 28, to provide the means which allow internally displaced persons to return voluntarily, in safety and with dignity, to their homes or places of habitual residence, or to resettle voluntarily in another part of the country, and to facilitate the reintegration of both groups.
وأول واجبات ومسؤوليات السلطات المعنية بالنسبة إلى هاتين الفئتين هي، كما ورد في المبدأ التوجيهي 28، توفير الوسائل التي تسمح للمشردين داخلياً بالعودة الطوعية في كنف الأمان والكرامة إلى ديارهم أو أماكن إقامتهم العادية أو إعادة الاستيطان الطوعي في مكان آخر من البلد، وتيسير إعادة إدماج الفئتين.

1. Internally displaced persons who have returned to their homes or places of habitual residence or who have resettled in another part of the country shall not be discriminated against as a result of their having been displaced.

١٦ - في المرفق ٧ لاتفاق السلام، طلب إلى مفوضية اﻷمم المتحدة لشؤون اللاجئين أن تقوم، في ضوء التشاور الوثيق مع اﻷطراف وبلدان اللجوء، بتنظيم عودة اللاجئين والمشردين إلى ديارهم أو إلى أماكن يختارونها.

2. Principle 28 recognizes that the competent authorities have the primary duty and responsibility to establish conditions, as well as provide the means, which allow IDPs to return voluntarily, in safety and with dignity, to their homes or places of habitual residence, or to resettle voluntarily in another part of the country.

54. According to the revised definition, the internally displaced are “persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of, or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized State border”.
وطبقاً للتعريف المنقح، يقصد بالمشردين داخلياً " اﻷشخاص أو مجموعات اﻷشخاص الذين حُملوا أو أُجبروا على الفرار أو على مغادرة ديارهم أو أماكن اقامتهم العادية، خاصة نتيجة، أو تجنباً ﻵثار نزاع مسلح، أو حالات من العنف الشامل، أو انتهاكات حقوق اﻹنسان، أو كوارث طبيعية أو من صنع اﻹنسان، ولم يعبروا حدود دولة معترف بها دولياً " .

Thus, the Guiding Principles use a broad notion of " internally displaced persons " as persons " forced or obliged to flee or leave their homes or places of habitual residence " for an array of reasons including " natural disaster " .

83. Internally displaced persons have a right to voluntary return in safety to their homes or places of habitual residence as soon as the reasons for their displacement cease to exist, or, as citizens of the country they are living in, to remain or resettle in another part of the country.
83- وللمشرَّدين داخلياً الحق في العودة الطوعية والآمنة إلى منازلهم أو أماكن إقامتهم المعتادة متى زالت أسباب نزوحهم()، أو لهم الحق، بصفتهم مواطنين في البلد الذي يعيشون فيه، في البقاء أو الانتقال للتوطُّن في موقع آخر من البلد().

2. For the purposes of these Principles, internally displaced persons are persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized State border.
2- ولغرض هذه المبادئ، يُقصد بالمشردين داخلياً الأشخاص أو جماعات الأشخاص الذين أُكرهوا على الهرب أو على ترك منازلهم أو أماكن إقامتهم المعتادة أو اضطروا إلى ذلك، ولا سيما نتيجة أو سعياً لتفادي آثار نزاع مسلح أو حالات عنف عام الأثر أو انتهاكات حقوق الإنسان أو كوارث طبيعية أو كوارث من فعل البشر ولم يعبروا الحدود الدولية المعترف بها للدولة.

(a) All 26 persons to whom this Opinion refers were arrested at their homes or places of work in simultaneous predawn raids on 14, 23 and 24 December 2006 and 14, 16 and 17 January 2007 by agents of the State Security forces (Amn Addawia) acting with the support of special units of the Army.
(أ) قيام قوات أمن الدولة بدعم من الوحدات الخاصة من القوات المسلحة بالقبض على جميع الأشخاص الستة والعشرين الذين يشير إليهم هذا الرأي في بيوتهم أو أماكن عملهم في هجمات متزامنة قبل الفجر في أيام 14 و23 و14 كانون الأول/ ديسمبر 2006 و14 و16 و17 قانون الثاني/يناير 2007.

The Guidelines and the above-mentioned Guiding Principles recognize the right of persons displaced by conflict or disaster to durable solutions, namely, a return to their homes or places of habitual residence (and, as key condition for durable return, to have housing or land restored to them), relocation elsewhere or local integration.
