In its Sixth Report, the Panel also determined that departure from Iraq or Kuwait prior to the jurisdictional period may not, in and of itself, be a bar to compensation for losses arising from an inability to return or a decision not to return to Iraq or Kuwait.
12- وفي التقرير السادس، قرر الفريق أيضاً أن مغادرة العراق أو الكويت قبل فترة الولاية قد لا تكون في ذاتها أو من ذاتها حائلاً دون التعويض عن الخسائر الناشئة عن العجز عن العودة أو عن قرار بعدم العودة إلى العراق أو الكويت(10).

For purposes of this report, the Panel will refer to those Jordanians and Palestinians who departed Iraq or Kuwait or who decided not to return to Iraq or Kuwait during the period 2 August 1990 to 2 March 1991 and who settled in Jordan as " returnees " .

c. claims for losses arising from an inability to return or a decision not to return to Iraq or Kuwait where the date of departure is in June or July 1990 and no Kuwaiti civil identification or Iraqi residency permit number is provided are not compensable; and
)ج( لا تعتبر قابلة للتعويض المطالبات بالتعويض عن الخسائر الناجمة عن العجز عن العودة أو اتخاذ قرار بعدم العودة إلى العراق أو الكويت التي يكون فيها تاريخ المغادرة في شهر حزيران/يونيه أو تموز/يوليه ٠٩٩١، والتي لم يتم فيها بيان رقم بطاقة الهوية المدنية الكويتية أو رقم تصريح اﻹقامة في العراق؛

The Panel has found that increased costs such as the cost of freight for diverting goods, costs of storing and handling goods or equipment that could not be delivered to Iraq or Kuwait or other compensable areas, costs of finding substitute markets, as well as associated administrative costs, are reasonable steps in mitigation of a claimant's loss.
222- رأى الفريق أن ازدياد التكاليف، من قبيل تكلفة الشحن لتغيير وجهة البضائع وتكلفة تخزين ومناولة البضائع أو المعدات التي تعذر تسليمها إلى العراق أو الكويت أو إلى مناطق أخرى مشمولة بقابلية التعويض، وتكاليف البحث عن أسواق بديلة، فضلاً عن التكاليف الإدارية المتصلة بذلك، هي تدابير معقولة لتخفيف خسارة صاحب المطالبـة.

With regard to the other increased costs such as the cost of diverting and storing goods which could not be delivered to Iraq or Kuwait, the " E2A " Panel has found these costs to be reasonable steps in mitigation of a claimant's loss and that such costs are compensable, provided they are appropriate in nature and reasonable in duration. /
153- وفيما يتعلق بازدياد التكاليف الأخرى من قبيل تكاليف تحويل وجهة البضائع التي تعذر تسليمها إلى العراق أو الكويت وتخزينها فإن الفريق المعني بالمطالبات من الفئة " هاء-2 ألف " وجد أن هذه التكاليف تعتبر خطوات معقولة للاقلال من خسائر الجهة المطالبة وأنها قابلة للتعويض بناء على ذلك بشرط أن تكون مثل هذه التكاليف مناسبة في طبيعتها ومعقولة في مدتها(93).
