It follows that the existence of a consistent pattern of gross, flagrant or mass violations of human rights in a country does not as such constitute sufficient grounds for determining that the particular person would be in danger of being subjected to torture upon his/her return to that country; additional grounds must be adduced to show that the individual concerned would be personally at risk.

6.3 Under general comment No. 1, whether the complainant has been tortured or ill-treated in the past must be taken into account so as to assess the risk of being subjected to torture upon return to her country.

9. For the abovementioned reasons, the Committee concludes that the complainant has failed to substantiate his claim that he would face a foreseeable, real and personal risk of being subjected to torture upon his return to Azerbaijan.
9- وللأسباب المشار إليها أعلاه، تخلص اللجنة إلى أن صاحب الشكوى لم يثبت ادعاءه بأنه سيواجه خطراً متوقعاً وحقيقياً يهدده شخصياً بالتعذيب عند إعادته إلى أذربيجان.

Regarding his past political activities, while the State party does not contest that the complainant appears to have been a regular member of the AXCP, it does contest that he could be considered a prominent person at risk of torture upon his return to Azerbaijan.
