The Committee notes with concern that article 227 bis of the Penal Code prohibiting sexual intercourse without violence with a child under the age of 15 only makes reference to girls, therefore not expressly protecting boys under 15 years old from such acts.

The Special Rapporteur also notes with concern that article 11 of a recent bill on a census needed for election purposes Projet portant organisation de l'identification des nationaux, du recensement de la population et de l'enrolement du corps électoral. stipulates that Zairian nationality is to be proved, inter alia, by " the identity card for citizens " , which makes the problem of the cards taken away from those expelled worse.

12. The Committee notes with concern that article 7 (sole paragraph) of the Constitution discriminates against domestic workers as it grants to this category of workers only 9 out of 34 rights enshrined therein and granted to other categories of workers.

(5) The Committee notes with concern that article 125 of the Criminal Code relating to violence and cruel acts is only applicable to specific individuals in investigation and trial processes, while other acts constituting torture that fall outside the scope of this article are dealt with under different provisions of the Criminal Code and are subject to lesser penalties.
