The present articles apply to activities not prohibited by international law and carried out in the territory or otherwise under the jurisdiction or control of a State which involve a risk of causing significant transboundary harm through their physical consequences.
تنطبق هذه المواد على اﻷنشطة التي لا يحظرها القانون الدولي والتي يجري الاضطلاع بها في إقليم إحدى الدول أو تحت ولايتها أو سيطرتها، وتنطوي على مخاطر إيقاع ضرر ملموس عابر للحدود بسبب نتائجها المادية.

(d) " State of origin " means the State in the territory or otherwise under the jurisdiction or control of which the hazardous activity is carried out;

" 1. The prior authorization of a State is required for activities within the scope of the present articles carried out in its territory or otherwise under its jurisdiction or control.
" ١ - يلزم الحصول على إذن مسبق من الدولة بشأن اﻷنشطة التي تدخل في نطاق هذه المواد والتي يُضطلع بها في إقليمها أو تحت ولايتها أو سيطرتها.

(j) " State of injury " means the State in the territory or otherwise under the jurisdiction or control of which transboundary damage occurs;

(d) " State of origin " means the State in the territory or otherwise under the jurisdiction or control of which the activities referred to in draft article 1 are carried out;
(د) يقصد بمصطلح " الدولة المصدر " الدولة التي يجري الاضطلاع في إقليمها أو تحت ولايتها أو سيطرتها بالأنشطة المشار إليها في مشروع المادة 1؛

1. If a State has reasonable grounds to believe that an activity planned or carried out in the State of origin territory or otherwise under the jurisdiction or control of another State may have a risk of causing significant transboundary harm, the former State may request the latter to apply the provision of article 9 [10].
1- إذا كان لدى إحدى الدول أسباب معقولة تدعو للاعتقاد بأن النشاط المزمع الاضطلاع به أو الجاري تنفيذه في إقليم الدولة المصدر دولة أخرى أو تحت ولايتها أو سيطرتها قد ينطوي على مخاطر التسبب في ضرر جسيم عابر للحدود، جاز للدولة الأولى أن تطلب من الدولة الثانية تطبيق حكم المادة 9 [10].

1. If a State has reasonable grounds to believe that an activity planned or carried out in the State of origin territory or otherwise under the jurisdiction or control of another State may have a risk of causing significant transboundary harm, the former State may request the latter to apply the provision of article 9 [10].
1 - إذا كان لدى إحدى الدول أسباب معقولة تدعو للاعتقاد بأن النشاط المزمع الاضطلاع به أو الجاري تنفيذه في إقليم الدولة المصدر دولة أخرى أو تحت ولايتها أو سيطرتها قد ينطوي على مخاطر التسبب في ضرر جسيم عابر للحدود، جاز للدولة الأولى أن تطلب من الدولة الثانية تطبيق حكم المادة 9 [10].

When no notification has been given of an activity conducted in the territory or otherwise under the jurisdiction or control of a State, any other State which has serious reason to believe that the activity has created a risk or has caused it significant harm may require consultations under article 18.
١ - في اﻷحوال التي لم يتم فيها اﻹخطار بنشاط يجري القيام به في إقليم إحدى الدول أو تحت ولايتها أو سيطرتها، يجوز ﻷي دولة أخرى لديها أسباب وجيهة للاعتقاد بأن ذلك النشاط قد أوجد مخاطر وقوع ضرر ملموس لها أو تسبب في هذا الضرر أن تطلب إجراء مشاورات بمقتضى المادة ١٨.

١ - إذا كان لدى إحدى الدول أسباب معقولة تدعو للاعتقاد بأن النشاط المزمع الاضطلاع به أو الجاري تنفيذه في إقليم دولة أخرى أو تحت ولايتها أو سيطرتها قد ينطوي على مخاطر التسبب في ضرر جسيم عابر للحدود، جاز للدولة اﻷولى أن تطلب من الدولة الثانية تطبيق حكم المادة ١٠.

States shall ensure that activities referred to in article 1 are not carried out in their territory or otherwise under their jurisdiction or control without their prior authorization.
يجب على الدول أن تتحقق من أن اﻷنشطة المشار إليها في المادة ١ لا يجري الاضطلاع بها في إقليمها أو تحت ولايتها أو سيطرتها دون الحصول على إذن سابق منها.

(8) This article does not oblige the States to require risk assessment for any activity being undertaken within their territory or otherwise under their jurisdiction or control.

34. In its future work, the ILC should maximize the freedom of States to conduct, within their territory or under their jurisdiction or control, activities which were not in themselves unlawful.
34 - ويتعين أن توسع لجنة القانون الدولي إلى أقصى حد، عند مواصلتها لأعمالها، نطاق حرية الدول في أن تمارس على إقليمها أو تحت ولايتها أو سيطرتها، أنشطة ليست غير مشروعة في حد ذاتها.

Authorization 1. The prior authorization of a State is required for activities within the scope of the present draft articles carried out in its territory or otherwise under its jurisdiction or control as well as for any major change in an activity so authorized.
١ - يلزم الحصول على إذن مسبق من الدولة بشأن اﻷنشطة التي تدخل في نطاق مشاريع المواد هذه ويُضطلع بها في إقليمها أو تحت ولايتها أو سيطرتها، وكذلك بشأن أي تغيير جوهري في نشاط أُذن به على هذا النحو.

In general, in the context of prevention, a State does not bear the risk of unforeseeable consequences to other States of activities not prohibited by international law which are carried on its territory or under its jurisdiction or control.
ولا تتحمل الدولة عموما، في سياق الوقاية، المسؤولية عن خطر تعرض دول أخرى للعواقب غير المتوقعة المترتبة على أنشطة لا يحظرها القانون الدولي تنفذ في اقليمها أو تحت ولايتها أو سيطرتها.
