3.1 The complainant maintains that, if he were sent back to Pakistan, he would be exposed to a serious risk of torture and ill-treatment in Pakistani prisons because of the criminal proceedings currently under way for a murder that he did not commit.
3-1 يدعي صاحب الشكوى أنه إذا ما أُعيد إلى باكستان سيتعرض لخطر جسيم بالتعذيب والمعاملة السيئة في السجون الباكستانية بسبب الإجراء الجنائي الجاري المتعلق بجريمة قتل لم يرتكبها.

Accordingly, the Committee requested the State party to provide the author with an effective remedy, including a full reconsideration of his claim regarding the risk of treatment contrary to article 7, should he be returned to Sri Lanka.

Nevertheless, in the Committee's view, the complainant has failed to adduce evidence about the conduct of any political activity of such significance that would still attract the interest of the Ethiopian authorities at the current time, nor has he submitted any other tangible evidence to demonstrate that he continues to be at a personal risk of being tortured if returned to Ethiopia.

8. In view of all the foregoing considerations, and having taken into account all the information made available to it, the Committee considers that the complainant has not produced elements sufficient to conclude that he personally runs a real and foreseeable risk of torture if returned to his country of origin.
8- واستناداً إلى مُجمل الاعتبارات السابقة، ومع مراعاة مُجمل المعلومات المُقدّمة إلى اللجنة، ترى اللجنة أن صاحب الشكوى لم يُقدم ما يكفي من العناصر التي تسمح بالخلوص إلى أنه يواجه شخصياً خطراً حقيقياً ومتوقّعاً للتعرّض للتعذيب إذا ما أُعيد إلى بلده الأصلي.

4.10 The State party also argues that the individual concerned must face a foreseeable, real and personal risk of being tortured if returned to the country of his origin.

4.17 For the State party, the fact that the complainant was a lawyer and a member of DUP does not in itself constitute sufficient grounds for assuming that if he were returned to the Sudan, he would be in danger of being subjected to treatment contrary to article 3 of the Convention.
