A possible solution could be to reword draft article 10, paragraph 1, slightly to allude to the issue, by inserting, after " injury to a national, whether a natural or legal person " the words " and whether or not the injury by itself constitutes a violation of international law " .

If an association or body acts in fact as a separate legal entity, it becomes a juristic person, with all its attributes, without requiring grant of legal personality by the State.
