Article 12 and article 12 bis of the Statute of the International Tribunal for Rwanda, as so amended, provide as follows:

It is my view that Ms. Rachid meets the qualifications which are prescribed in Article 12 of the Statute of the International Tribunal for Rwanda.

The Statute of the International Tribunal for Rwanda does not contain a provision similar to Article 13, paragraph 3, of the Statute of the International Court of Justice, whereby judges of that Court continue to discharge their duties until they are replaced and, thereafter, until they finish any cases which they may have begun.
ولا يتضمن النظام الأساسي للمحكمة الدولية لرواندا نصا شبيها بالفقرة 3 من المادة 13 من النظام الأساسي لمحكمة العدل الدولية، الذي بموجبه يستمر أعضاء المحكمة في القيام بعملهم إلى أن يعيّن مَن يخلفهم، وبعد ذلك إلى أن تنتهي القضايا التي قد بدأوها.

Note: the massacre at Kamituga constitutes an act of genocide within the meaning of article 2 (2) of the Statute of the International Tribunal for Rwanda.

3. The Statute of the International Criminal Tribunal for Rwanda, like that of the International Tribunal for the Former Yugoslavia, does not spell out in detail the judicial functions of the judges.
٣ - إن النظام اﻷساسي للمحكمة الجنائية الدولية لرواندا، شأنه شأن النظام اﻷساسي للمحكمة الدولية ليوغوسلافيا السابقة، لا يورد بالتفصيل الوظائف القضائية التي يؤديها القضاة.
