71. A new law on the High Judicial and Prosecutorial Council is being prepared and discussed within the Structured Dialogue.
٧١ - ويجري إعداد قانون جديد بشأن المجلس الأعلى للقضاء والادعاء العام وتجري مناقشته في إطار الحوار المنظم.

It commended the establishment of the Council for Children to monitor implementation of the Convention on the Rights of the Child (CRC) and the related action plan on children's rights, as well as the reform of the High Judicial and Prosecutorial Council.

173. Data from the Annual Report of the High Judicial and Prosecutorial Council of BiH for 2009, show that women's representation in the courts is about 64% (563 women and 315 men), and in prosecutor's offices 46% (138 women and 160 men).
173- وتظهر البيانات المستمدة من التقرير السنوي للمجلس الأعلى للقضاء والادعاء العام في البوسنة والهرسك المتعلق بـ 2009 أن المرأة ممثلة في المحاكم بنسبة 64 في المائة تقريباً (563 امرأة مقابل 315 رجلاً)، وفي مكاتب الادعاء العام بنسبة 46 في المائة (138 امرأة مقابل 160 رجلاً).

The election of all judges and prosecutors in BiH (except the election of judges to the Constitutional Court of BiH) is conducted by the High Judicial and Prosecutorial Council in accordance with the Law on High Judicial and Prosecutorial Council of BiH, which further ensures the independence of the courts.

The analysis of the Law on High Judicial and Prosecutorial Council of BiH (HJPC BiH) (Official Gazette of BiH, 25/04, 32/07, 48/07 and 15/08), indicated that the Law contains provisions that prohibit discrimination based on gender and introduce the obligation of equal gender representation in appointments to all judicial functions at all levels of the judiciary.
171- أشار تحليل قانون المجلس الأعلى للقضاء والادعاء العام في البوسنة والهرسك (الأعداد 25/4 و 32/7 و 48/7 و 15/8 من الجريدة الرسمية للبوسنة والهرسك) إلى احتواء القانون على أحكام تحظر التمييز استناداً إلى النوع الجنساني وتُلزم لأول مرة بتمثيل الجنسين على قدم المساواة عند إجراء التعيينات لشغل أية وظيفة قضائية بجميع مستويات القضاء.
