وليس لدى كوبا أي اعتراضات أو ملاحظات بشأن صياغة مشاريع المواد المتبقية، وإن كانت تود أن تؤكد من جديد موقفها بأن حقوق الإنسان للأشخاص المطرودين أو الجاري طردهم لا يمكن أن تشكل قيدا على ممارسة حق دولة ما في تنفيذ عمليات الطرد.

1. Children, older persons, persons with disabilities and pregnant women who have been or are being expelled shall be considered, treated and protected as such, irrespective of their immigration status.
1- يجب مراعاة ومعاملة وحماية الأطفال، والأشخاص المسنين، والأشخاص المعوقين، والحوامل المطرودين أو الجاري طردهم بما يتفق مع حالتهم، بغض النظر عن نوع إقامتهم.

With respect to the draft articles on " Expulsion of aliens " , Cuba considers that the codification of the human rights of persons who have been or are being expelled would be useful, provided that such a codification is guided by the principle of comprehensive protection of the human rights of the person who has been or is being expelled, and does not infringe on the sovereignty of States.
فيما يتعلق بمشاريع المواد بشأن " طرد الأجانب " ، ترى كوبا أن تدوين صكوك حقوق الإنسان للأشخاص المطرودين أو الجاري طردهم قد يكون مفيدا، شريطة أن يسترشد هذا التدوين بمبدأ الحماية الشاملة لحقوق الإنسان الخاصة بالشخص المطرود أو الجاري طرده، وألا يمس بسيادة الدول.

40. With regard to draft article 8 (General obligation to respect the human rights of persons who have been or are being expelled), her delegation firmly believed that the establishment of a hierarchy among such rights should be avoided and that it would be extremely difficult to set out an exhaustive list of rights to be protected in the context of expulsion.

42. Concerning draft article 9 (Obligation to respect the dignity of persons who have been or are being expelled), her delegation agreed that human dignity was the foundation of human rights and a fundamental value to be respected and protected in all circumstances.
