The Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas forms an integral part of the Code.

Fisheries authorities could also cancel or suspend a high seas fishing permit where they had determined that the vessel in respect of which the permit had been granted had engaged in activities undermining the effectiveness of International Conservation and Management measures.

Those activities were aimed at preparing the ground for the future ratification of the Fish Stocks Agreement and the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas (Compliance Agreement).

When a fishing vessel is voluntarily in the port of a party, that State shall promptly notify the flag State where it has reasonable grounds for believing that the vessel has been used for an activity that undermines the effectiveness of International Conservation and Management measures. 86/

(i) Non-parties to a subregional or regional agreement or arrangements: this paper contained measures to be taken to ensure that non-parties to a subregional or regional agreement or arrangement do not engage in activities that undermine the effectiveness of relevant International Conservation and Management measures;

Second, the legally binding Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas (the Compliance Agreement) was approved by the FAO Conference in November 1993 and has so far been signed by seven States.

In this regard, while pleased at the entry into force of the United Nations Convention on the Law of the Sea, the Meeting noted that only a small number of countries had so far ratified the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas and the Agreement on the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks.’

Specifically, the draft provided that the authorities responsible for fisheries would not issue a high seas fishing permit in respect of a vessel unless they had been satisfied that the State would be able to exercise effectively its responsibilities with respect to that vessel under the Compliance Agreement, the 1995 Fish Stocks Agreement and International Conservation and Management measures recognized by it.

136. On 24 November 1993, the FAO Conference unanimously adopted a resolution approving the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas. 83/ The Agreement was done in response to problems caused by flagging or reflagging of fishing vessels as a means of avoiding internationally agreed conservation and management measures and fair trade practices.
١٣٦ - اتخذ مؤتمر الفاو باﻹجماع في ٢٤ تشرين الثاني/نوفمبر ١٩٩٣ قرارا باعتماد اتفاق تعزيز امتثال سفن الصيد في أعالي البحار لتدابير الحفظ واﻹدارة الدولية)٨٣(. وقد وضع الاتفاق استجابة للمشاكل الناشئة عن رفع أعلام على سفن صيد السمك أو تغيير اﻷعلام بأعلام دول أخرى كوسيلة لتفادي تدابير الحفظ واﻹدارة المتفق عليها دوليا والممارسات التجارية المنصفة.
