It should be stressed that the rights and freedoms mentioned in article 5 do not constitute an exhaustive list.

(c) As the Committee stated in its General recommendation XX, " many of the rights and freedoms mentioned in article 5, such as the right to equal treatment before tribunals, are to be enjoyed by all persons living in a given State " , thereby confirming the impossibility to deny protection on the basis of territorial jurisdiction.

The Government has not contested the prima facie case in a way which gives this Working Group any alternative but to reach the conclusion the detention of Kiarash Kamrani follows from the exercise of the rights and freedoms as mentioned above, and that there are no grounds to justify the restriction of those rights.
22- ولم تعترض الحكومة على الادعاء الظاهر الوجاهة بطريقة تمكن هذا الفريق العامل من أي بديل سوى استنتاج أن احتجاز كياراش كامراني ناجم عن ممارسة الحقوق والحريات المشار إليها أعلاه، وإلى أنه لا وجود لأسباب تبرر تقييد هذه الحقوق.
