Withdrawal by staff representatives from joint bodies does not constitute interference with official functions since the Tribunal has ruled that, in such cases, the Administration may proceed without the consultation normally needed pursuant to article VIII of the Staff Regulations and chapter VIII of the Staff Rules.

Moreover, all expenditures from such funds would require the prior review and approval of the related budgets by the Board of Trustees of UNITAR, in accordance with paragraph 2 of article III and paragraph 1 of article VIII of the statute;

6. Paragraph 13 of article VIII of the statute of UNITAR would be amended to read:

After completion of consultations with staff representatives on the subject of staff relations, any proposed amendment to article VIII of the Staff Regulations and related changes in Chapter 8 of the Staff Rules will be submitted to the General Assembly for its consideration.

2. Since the requests contained in paragraphs 2, 3 and 4 of the draft resolution could be implemented only after the amendment of paragraph 13 of article VIII of the statute of UNITAR, it would be appropriate to structure the draft resolution so that the substance of operative paragraph 5 precedes paragraphs 2, 3 and 4.
