The State party recalls that the author was well aware of the facts that gave rise to the charges against him at his trial on 24 April 1992 since on 19 December 1991 Ms. Gascon had testified and had been crossexamined on them during the preliminary investigation.

8.2 Concerning the State party's assertion that the author was indeed a member of an organized criminal group, the author takes strong exception, observing that this is the first occasion the State party has ever made such an assertion.

The State party recalls that the author was an employee of the Hyrnó company and that at the time the company had already made use of the permanent quota share that its vessels had been allocated on the basis of article 7 (2) of the Act.

The State party refers to the Committee's jurisprudence and submits that the author was represented by a lawyer at every stage of the proceedings against him and, accordingly, the absence of a lawyer from 24 to 27 December 1999 did not result in a violation of his right under article 14, paragraph 3(d), of the Covenant.

6.1 In its submission under article 4, paragraph 2, of the Optional Protocol, dated 15 September 1993, the State party concedes that the author has been a victim of arbitrary interference with his privacy, and that the legislative provisions challenged by him cannot be justified on public health or moral grounds.
٦-١ اعترفت الدولة الطرف المعنية في رسالتها المؤرخة ١٥ أيلول/سبتمبر ١٩٩٣، التي وجهتها بموجب الفقرة ٢ من المادة ٤ من البروتوكول الاختياري، بأن صاحب البلاغ كان ضحية تدخل تعسفي في خصوصياته وبأن اﻷحكام التشريعية التي طعن فيها لا يمكن أن تبرﱠر على أساس حفظ الصحة العامة أو اﻷخلاق.
