55. The Commission on Human Rights has consistently requested the Special Rapporteur to monitor the implementation of all standards relating to the imposition of capital punishment.

8.4 In the light of the above finding of a violation of article 6 of the Covenant, the Committee need not address the authors' remaining claims which all concern the imposition of capital punishment in their case.

Thailand was urged to consider withdrawing its reservations to CEDAW and CRC and its declarations to ICCPR, including that related to the imposition of the death penalty on persons below 18 years of age.

Despite the excellent reputation of the United States judiciary, the Special Rapporteur observes that the imposition of death sentences in the United States seems to continue to be marked by arbitrariness.

As regards the imposition of death sentences on minors, the Special Rapporteur was informed that, in judicial practice, the overwhelming majority of offenders sentenced to death with a two-year suspension had their sentences reduced at the end of the two years, and that the people's courts were especially cautious about sentencing minors between 16 and 18 years of age to death with a two-year suspension.
وفيما يتعلق بتوقيع عقوبة اﻹعدام على القصﱠر، أُبلِغ المقرر الخاص أنه من حيث الممارسة القضائية فإن اﻷغلبية الساحقة من الجناة الذين حُكم عليهم باﻹعدام مع وقف التنفيذ لمدة سنتين، قد خُففت اﻷحكام الصادرة عليهم في نهاية فترة السنتين، وأن محاكم الشعب تلتزم الحذر بوجه خاص بخصوص الحكم باﻹعدام، مع وقف التنفيذ لمدة سنتين، على القصر الذين تتراوح أعمارهم بين ٦١ و٨١ سنة.

In order to scrutinize whether safeguards relating to capital punishment are being observed, it is urged that every court decision awarding capital punishment must record the safeguards to be observed and that the decision be made public.
وبغية التثبت من مدى التقيد بالضمانات المتصلة بعقوبة الإعدام، تحث المقررة الخاصة على أن تورد في كل حكم تصدره بتوقيع عقوبة الإعدام الضمانات الواجب مراعاتها وعلى أن تعلن هذه الأحكام.

103. According to the information received, trials resulting in the imposition of a death sentence continue to fall short of internationally recognized fair trial standards.
