“(5) The arbitral tribunal may require the requesting party to provide appropriate security as a condition to granting an interim measure of protection.
" (5) يجوز لهيئة التحكيم أن تلزم الطرف الطالب بتقديم ضمان مناسب كشرط للموافقة على تدبير الحماية المؤقت.

" (3) The party requesting the interim measure of protection shall satisfy the arbitral tribunal that:

This subparagraph shall not affect the authority of the arbitral tribunal to grant, confirm, extend, or modify an interim measure of protection under paragraph (1) after the party against whom the measure is directed has been given notice and an opportunity to be heard.
ولا تمس هذه الفقرة الفرعية بالسلطة المخوّلة لهيئة التحكيم في أن توافق على تدبير الحماية المؤقت أو تأكيده أو تمديده أو تعديله بمقتضى الفقرة (1) بعد أن يكون الطرف الذي يوجه التدبير ضده قد أُشعر بذلك وأعطي فرصة لسماع رأيه.

“(7) The arbitral tribunal may modify or terminate an interim measure of protection at any time.”
" (7) يجوز لهيئة التحكيم أن تعدّل تدبير الحماية المؤقت أو تنهي العمل به في أي وقت. " .

However, it was observed that, even if the words “any party” were used, the text of paragraph (5) would still refer to security being provided “as a condition to granting an interim measure of protection”, thus avoiding any risk that the security would be required from the defendant.

One view was that the words “an opportunity to be heard”, should be replaced by a reference to the “right” of the party to be heard in order to make it clear that an arbitral tribunal having issued an ex parte measure of protection should stand ready to be activated on short notice by the affected party.
وجاء في رأي ما مفاده أنه ينبغي الاستعاضة عن عبارة " فرصة لسماع آرائه " بالاشارة إلى " حق " الطرف في سماع آرائه بغية التوضيح بأنه ينبغي لهيئة التحكيم، بعد أن تكون قد أصدرت أمرا باتخاذ تدبير الحماية بناء على طلب طرف واحد، أن تكون جاهزة لمعاودة نشاطها خلال فترة اشعار قصيرة يعطيها الطرف المتأثر.

523. So, by way of example, if the detainee lodges the request for amparo on the first day that the preventive custody comes into effect and on the tenth day the constitutional judge holds the hearing and rules that the protective measure is unconstitutional, it will be rescinded.
